My wife tried to get a DVRO for her green card. Judge denied the initial one (no hearing) and again at the hearing based on lack of evidence. Having said all that, I left the apartment and she took too long to file. If she was smarter, yes, I could have been screwed.

It definitely made me feel better about the system.

I don't know if a RO without a trial goes on your record.

In my state, to get an order of protection (OP) you have to appear before a judge and ask. If the other side isn't there to defend themselves it's a request for an "emergency" OP and you have to argue why things can't wait until the other party can be there. Maybe not the biggest hurdle if you lie / exaggerate. But Judges seem to understand the magnitude of an OP so will set a status date for Emergency OP's maybe one week later to give you the chance to give your side. Once they can talk to everyone they decide is an OP is really needed. If one side doesn't show up, they lose. I've filed for them a few times and they were granted. At status we've figured out an agreed order to address the underlying issue giving rise to the need for the OP so I dropped request each time.

Yes, this. God damn it! .

In my state, all you need if reasonable fear of danger to have a protective order issued. I went to the hearing and the judge even noted that I am a good dad but because my wife had two affairs, it was reasonable that I could cause harm to her and issued the protective order.
