What do you want to bet this becomes a weaponized?

[–]PeonSupreme 29 points30 points31 points 5 years ago (14 children) | Copy Link

I’d say it was tailor made to be weaponized.

[–]OneCrazyCook84 9 points10 points11 points 5 years ago (13 children) | Copy Link

Colleges for years have hidden and kept sexual assaults to keep their own image polished.

Most states keep a victims information private until a trial anyways. The victims name is only made public at that point because of the defendants constitutional right to know who the accuser is.

This completely undermines the 6th amendment completely.

[–]PeonSupreme 8 points9 points10 points 5 years ago (1 child) | Copy Link

They put their own interests ahead of both the accusers and the accused.

[–]OneCrazyCook84 1 point2 points3 points 5 years ago (0 children) | Copy Link

That's for sure.

The victims name is only made public at that point because of the defendants constitutional right to know who the accuser is.

Not so.

In the UK the law guarantees lifelong anonymity for any woman who makes a rape accusation, even if it's later proven false.

Most states have blended anonymity for accusers into their rape shield laws.

  • Who can Remain Anonymous in a Criminal Case?

  • Victim of rape and other forms of sexual assault receive special protection under the law. States have adopted so-called rape shield laws to create these protections. In one sense, rape shield laws are laws that prevent the questioning of sexual assault victims from being questioned about their past sexual behavior, in an attempt to paint them as complicit in their own assault. However, the term may also refer to laws that prevent the public release of the victim’s identity.

  • The federal Violence Against Women Act created a rape shield law. This law both prevents questioning of victims about past sexual behaviour, and prevents the release of their identity. News stations typically will not reveal rape victims’ identities.

  • The protection of sexual assault victims’ identities is pretty specific, but laws preventing the release of the identity of victims of other crimes are less so. For these other victims, protections will be based upon the law of the state in which they live. Some states have passed Marsy’s laws. This type of law was first passed in California, and has since been adopted by a number of other states.

As for protecting the identity of the accused unless there is a conviction, that's not a thing.

At no point did you show my statement to be inaccurate. Thank for playing🤡🤡

I didn't say anything about protecting the identity of the accused. I said,"accusations will be weaponized."

Here in the US you are presumed innocent until proven guilty. False accusations destroy a person's life. Until the burden of truth is met their names should be kept private.

I can randomly bring up 2-3 articles of BS too but I don't need to use other people's words and opinions to form my own.

[–]tenchineuro 1 point2 points3 points 5 years ago (8 children) | Copy Link

Incorrect, you claim that the "victims name is only made public at that point because...". At no point are the names of rape accusers made public, neither in the US or the UK.

I didn't say anything about protecting the identity of the accused.

I agree, I added that in because I thought it was important.

Here in the US you are presumed innocent until proven guilty.

I'll see that and raise one anonymous #metoo accusation.

Until the burden of truth is met their names should be kept private.

That was kinda my point in bringing it up.

[–]OneCrazyCook84 -3 points-2 points-1 points 5 years ago (7 children) | Copy Link

In the US they the victim can be called into court during the trial. It's not put into the paper but those in the court room will see the victim. Many cases the court rooms are cleared. It's a public courtroom with members of the public.

I'll see your #metoo and raise you BS.... That movement has been weaponized and made a joke. The joke of the accusations against Trump. It was documented and reported that Lisa Bloom was using quid quo pro to get women to make statements🤡🤡

Here's a point for you, cite the actual legal document instead of posting some bogus article from legal match. That alone shows me you have no clue what you're talking about. Had you cite the actual law you'd know it was ruled my the SCOTUS. Meaning all courts in the US have to follow it.

I was speaking of the US I don't care about UK. I hope it sinks, it's a dumpster fire.

[–]tenchineuro 2 points3 points4 points 5 years ago (6 children) | Copy Link

In the US they the victim can be called into court during the trial. It's not put into the paper but those in the court room will see the victim. Many cases the court rooms are cleared. It's a public courtroom with members of the public.

But she won't be named, she will be a 'Jane Doe', she will be anonymous and the state law will requite that her identity be kept secret.

Here's a point for you, cite the actual legal document instead of posting some bogus article from legal match.

Like you do? What a laugh.

[–]OneCrazyCook84 -4 points-3 points-2 points 5 years ago (5 children) | Copy Link

I'm not the one making the assertion that someone else is wrong.

You're the one here attacking the credibility of my statements with no actual evidence.

Here I'll show you the legal match page is wrong

https://www.justice.gov/enrd/rights-victims

One my several rulings SCOTUS has made. It lists the codes too, justice.gov enter those codes into the search bar and you can read the entire law. In fact is gives you the 1990 law that was the precedent prior. "What a laugh"

How's your superiority complex doing?

[–]tenchineuro 3 points4 points5 points 5 years ago (4 children) | Copy Link

I'm not the one making the assertion that someone else is wrong.

You asserted this,.

  • The victims name is only made public at that point because of the defendants constitutional right to know who the accuser is.

Feel free to post the legal documents that support this.

And your link says nothing about anonymity, which is the thing at issue.

How's your superiority complex doing?

No problems so far.

[–]OneCrazyCook84-1 point 5 years ago [recovered] | Copy Link

It's the 6th Amendment to the Constitution of The United States of America🎉🎉🎉🎉

Your opinion hasn't mattered since 1776🤠🤠🤠yeehaww!!! 🤣🤣🤣

[–]tenchineuro3 points 5 years ago [recovered] | Copy Link

It's the 6th Amendment to the Constitution of The United States of America

First off, constitutional amendments are not law.

Second...

  • In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence.

This says nothing about anonymity either.

And it actually does not say that he has a right to know what his accuser's name is, it just says that he has a right to confront her.

You do recall that this claim is at issue...

  • The victims name is only made public at that point because of the defendants constitutional right to know who the accuser is.

The point at issue specifically is your claim that her name is made public.

And your use of the word 'victim' rather than accuser seems to indicate that you think any accused man guilty.

[–]OneCrazyCook841 point 5 years ago [recovered] | Copy Link

They are the basis for how law is made in the US. Laws can not violate these rights... That's the whole point of our Supreme Court.

https://www.law.cornell.edu/wex/right_to_confront_witness

Again it's in the rules of how the court works in the US so yes it's law.

I'm not going to entertain your idiotic games anymore. Maybe don't run your mouth about how another country works when you clearly don't know.

To say they are not law is to show you know nothing about the US please stay in your own lane.

[–]tenchineuro3 points 5 years ago [recovered] | Copy Link

You've still not addressed your claim that rape accusers names are made public.

How about posting the name of just one rape accuser who's name was made public?

And this is boring, you have yet to address the only thing at issue, I don't even think you understand the issue.

There is nothing in the Constitution dealing with accuser anonymity, this is part of rape shield laws, which themselves are probably unconstitutional as they deny equal protection under the law.

So have a nice day.

===

And the constitution is not law. That letter to King George is not law either. And the government violates the constitution all the time, it's very expensive to take a case to the Supreme Court, so most violations remain unaddressed.

Didn't Biden just eliminate the safe guards for the accused that were established by the Trump administration?

[–]ipwr85 12 points13 points14 points 5 years ago (1 child) | Copy Link

Under the standards Biden advocates he would have been found guilty of sexual assault.

[–]__pulsar 6 points7 points8 points 5 years ago (0 children) | Copy Link

Rules for thee, not for me!

[–]PeonSupreme 5 points6 points7 points 5 years ago (0 children) | Copy Link

[–]tenchineuro 6 points7 points8 points 5 years ago (0 children) | Copy Link

  • The website stresses that using the anonymous reporting form is not the same thing as filing a formal Title IX complaint, which would automatically trigger an investigation.

Yes, and?

  • These investigations attracted significant criticism from civil liberties advocates for abridging the due process rights of accused students,

I see, so the idea is to get rid of that troublesome investigation and probably just expel the accused student.

  • though the process was overhauled by the Trump administration to restore basic fairness.

About that...

I think the anonymity will help though. From what I see, most people make up accusations for 1. Fame and 2. Attention. And when anonymity is added, you can't get those.

[–]bufedad 13 points14 points15 points 5 years ago (1 child) | Copy Link

And when anonymity is added, you can't get those.

You can get revenge for perceived slights.

Another thing you can't get? A fair trial.

[–]tenchineuro 2 points3 points4 points 5 years ago* (0 children) | Copy Link

Another thing you can't get? A fair trial.

You can't get a fair hearing at a university either. But at least it will take Biden months if not years to make any changes.

[–]PeonSupreme 6 points7 points8 points 5 years ago (2 children) | Copy Link

Oh crap no. There’s already been all these anonymous Twitter pages where the women just pile on the accusations.

[+]kuvirashandcuffs -9 points-8 points-7 points 5 years ago (1 child) | Copy Link

But unlike the twitter pages, these accusations aren't public and thus have less of a chance of drawing attention.

[–]OneCrazyCook84 5 points6 points7 points 5 years ago (0 children) | Copy Link

Lol, the consequences for the accused are the same.

[–]OneCrazyCook84 0 points1 point2 points 5 years ago (0 children) | Copy Link

Doesn't change the end result of what happens to the accused, who is said situations is the actual victim.

The US government did a study that determined only about 20% of reported sexual assaults were report to police.

[–]JoeSmith1907 0 points1 point2 points 5 years ago (0 children) | Copy Link

I guess they think they have too many people applying. I can't imagine a non-simp guy in his right mind applying there, especially after this. As for the girls, let's say a parent of a daughter who is considering going to Brown, goes on the campus tour and asks what percentage of the girl students report being victims of sexual misconduct, and then they say something like "Now that we have our anonymous reporting system, it's 9 out of 10 girls." When you hear that are you going to want your daughter to go there?
