My divorce left me with substantial alimony payments and marital debt thanks to my greedy ex. My alimony payments will be over in about two months and we will need to go back to court to re-calculate child support payments. I always suspected that my ex will deploy her old tricks to claim higher child support payments when we go back to court. Surprise, she just informed me that she is no longer employed. I cannot 100% confirmed but I am almost certain she didn't get fired or laid off but quit. She works in a daycare.
What makes this more egregious and self-centered is that my daughter attends the daycare my ex works at and we receive substantial employee discounts through my ex. Now, that my ex has left the daycare, my daughter's daycare tuition has gone up by $1000+ per month. I am responsible for most of the daycare expenses.
I would like to know - how do I go about making sure that my ex does not succeed in claiming unemployed status when we go back to court to re-calculate child support? I imagine that this is a very common tactics that men and women can use to lower the child support responsibilities. I would appreciate any advice on how to handle this situation so that my ex does no succeed in her scheme. What documents are required when applying to modify child support? One thing I was thinking is maybe hire a lawyer to subpoena her employment records and circumstances surrounding her departure?
