People found guilty of rape normally get longer sentences compared to people found guilty of sexual assault

With no aggravating factors, the suggested sentence for rape is longer than the suggested sentence for sexual assault

Rape is also often viewed as worse than sexual assault

It also means that rape is seen as a gendered crime on rape statistics in which only men are the perpetrators and women are the victims, which is false

I hope you don't mind, I wrote a fairly lengthy response to a post similar to this so I'm just going to copy and paste it here for awareness.

You'll have to forgive me for the length of this post but the same petition goes up quite regularly and regularly garners enough signatures to warrant a response. The government response is always the same. We need to move on from this to get the issue resolved and start highlighting the problems with that response rather than just repeatedly asking the same questions that garner the same response.

You can see the full response to one of the previous petitions here https://petition.parliament.uk/petitions/300270?reveal_response=yes but the essence of it is that they won't change the act because the male equivelant is supposedly already dealt with under section 4(4) of the same act, with the same mandatory sentencing as would be applied for a rape charge. Even if this claim were true (which I'm about to show you, it isn't) the concept of gender specific laws for either men or women is problematic and overly beauracratic at best; I've copy and pasted the entirety of section 4 below from the act for clarity but the response directs us to subsection 4 specifically.

Causing a person to engage in sexual activity without consent (1)A person (A) commits an offence if— (a)he intentionally causes another person (B) to engage in an activity, (b)the activity is sexual, (c)B does not consent to engaging in the activity, and (d)A does not reasonably believe that B consents.

(2)Whether a belief is reasonable is to be determined having regard to all the circumstances, including any steps A has taken to ascertain whether B consents.

(3)Sections 75 and 76 apply to an offence under this section.

(4)A person guilty of an offence under this section, if the activity caused involved— (a)penetration of B’s anus or vagina, (b)penetration of B’s mouth with a person’s penis, (c)penetration of a person’s anus or vagina with a part of B’s body or by B with anything else, or (d)penetration of a person’s mouth with B’s penis,is liable, on conviction on indictment, to imprisonment for life.

(5)Unless subsection (4) applies, a person guilty of an offence under this section is liable— (a)on summary conviction, to imprisonment for a term not exceeding 6 months or to a fine not exceeding the statutory maximum or both; (b)on conviction on indictment, to imprisonment for a term not exceeding 10 years.

Now, remember we're directed to look at (4). Can anyone point out where in that subsection it deals with a female forcing a male to penetrate her as the government response claims? It doesn't. Best of it is, the particular subsection is clearly designed to apply mainly to men, with the only caveat within that subsection being that a woman can also be guilty of something if she uses an object to penetrate someone against their will. In addition the only part of that entire section which carries a mandated life sentence (the same as rape) is penetration of a mouth with a penis....... Which is actually dealt with under section 3 anyway. It just seems that it has been included to ensure men who do that to other men are dealt with aswell. Sentencing guidelines are contained in subsection 5 which clearly says summary (less serious) offences carry a maximum term of 6 months and indictable (the most serious offences) carry a maximum term of 10 years. This is not equal treatment in any way; it is ignoring the question in the knowledge that people can't reply to your statements and the hope that nobody will bother to check and it will all just go away.

Anyway, sorry for taking up space on your thread - I hope the petition succeeds but I wouldn't expect a different response.

Correct me if I'm wrong, but I think it's worth noting that the current wording doesn't just exclude women from raping men, but also women from raping other women. Granted the later is probably less frequent (I haven't checked, but I'd assume so), but the point is the law needs to cover all bases. It's just as important that female victims of female rapists are represented in the law as male victims of female rapists. If the purpose of the petition is to represent all possible victims properly, it should probably be reworded so it actually says that.

I feel that false accusations against men for rape should also be considered sex crimes and punishable by both jail time and registration on a sex offender site.

These subsections can only apply when the offender penetrates a victim, so yes a woman taking a dildo and shoving it up someone's butt would apply but if a woman was holding a gun to your head, drugged you etc etc and forces the man to penetrate her it wouldn't...... That's what is meant by 'made to penetrate'. Parts c and d are actually used, in practice, to ensure people who participate in a rape (i.e by holding someone down while they do it) are convicted.

So the u.k government has openly admitted they give preferential treatment to women who get in trouble with the law too many times.

Rape laws and assault by penetration laws made it very clear, the perpetrator must have a penis and uses male pronouns.

The rape discourse is entirely controlled by feminists, so are all those rape centers including those brand new useless "centers for men", we have in the uk, a bunch of prison reform programs basically advocating to legalize all crimes when perpetrated by women.

And we are supposed to believe in the u.k parliament that they give female and male rapists the exact same punishment, that female perpetrated rape isn't legal and that male victims are taken as serious as female victims because muh SExUAl Ass@uLt @ccTt.
