I've face DV and abuse claims and more during our divorce. I am pretty sure I would have been arrested and deported if I didn't sign the divorce papers as she served me (even a lawyer confirmed that he had a client that got ruined by his wife who bashed the shit out of her head and claimed it was him). So, now to the topic. Should I file a motion and try to get 50/50 straight away (due to parental alienation, domestic violence against my child - hard to be proven as he is a toddler, and maybe some other reasons), or would a judge be more likely to a agree to a step up plan (start with 1 overnight per week, and add 1/2 to 1 night per year until 50/50 custody)?
