Well it really doesn't matter how you look at a car its combined debt she will still owe half of that $8 k . and I don't know how long you have been married but after I think it's 7 years married she will get part of any 401k or pension as you will get part of hers also then there is c.f. debt even if she spends more than you she will owe half of it. What about equity in a home or are you renting. . if she has a c.f. in just her name that's her debt . what about joint checking and savings . split all of that also who makes more $$$ .

The car isn't likely to be the single asset divided in divorce - so don't make the mistake of agonizing over every item you're getting or she's getting. Do some math on the big picture, because if you agree or concede on one asset early on, you'll fall into the trap of negotiating everything piecemeal.

For a car, you're going to look at its value minus what you owe on it - that's the equity you'll split. You're looking at under $4k. If she's agreeable, just give her the $4k.

It might get more difficult depending who's on the title and who's making the payments. If the car is in her name I wouldn't even try changing ownership or getting a new loan, just let it go. $4k isn't even a fraction of what a contested divorce is going to cost either of you.
