Technically no. False rape accusations = mistakes OR fraudulent rape accusations. The former is simply inclusive of the latter.

The problem is that many news reports and even legal references use "false rape accusation" to refer to intentionally fraudulent accusations, which muddies the waters.

And no, we shouldn't fry a person for a mistake, but think of this in the criminal context. If you intentionally kill someone, it's murder. If you accidentally kill them, it's involuntary manslaughter if you were reckless or negligent. We shouldn't let someone off the hook just because they made a mistake if that mistake was recklessly or negligently made. Someone's life and livelihood is still put at risk, and he may suffer permanent harm to his reputation.

Although a better solution than punishing the accuser in that sort of situation may be to award automatic monetary payment to the accused if the charges that are brought are deemed to be unfounded (as compensation for the harm to his reputation, etc.). That way, prosecutors and police officers will have a strong incentive to make sure that a correct identification is made.

No one who advocates for the wrongly accused wants accusers to be prosecuted unless it can be shown to a moral certainty that she deliberately lied about rape. To suggest otherwise is a straw man argument fomented by persons who don't think false accusers should ever be prosecuted -- and, yes, there are some prominent members of the sexual grievance industry who think it is never appropriate to charge false accusers.

This happens at least as much as outright fraudulent accusations, and usually it's the police or a prosecutor behind it. They just want a conviction to clear the case and make a stat all too often. The rape victim gets browbeaten and forced ot make an ID. She gets victimized a second time.

This happened in a case where a woman identified a man who was later shown to be absolutely innocent. She felt awful - though she had been browbeaten into identifying somebody, anybody and thus she wasnot the real culprit; she just has that strong a sense of justice - and now they both go around giving talks to raise awareness. I can't recall their names at the moment.

Feminist dominate the gender narrative and use it to demonize men. They affect the media, what's taught on campus, the training of law enformcent, judges, etc.. They have feminists throughout the judicial process (advocates, social workers, etc..). I've got much bigger fish to fry focusing on misandry and victimized men.
