Throwaway account here. I've got an appointment to see a lawyer on Friday but I thought I'd see what light /MensRights could shed on my situation before then.
Here are the facts I'm dealing with:
*Met a woman from out of state last year
*She visited my city 3-4 times
*We met at a neutral site once
*She convinced me early on that she was unable to have children due to some medical thing that I don't recall the details of (stop laughing, I know I'm an idiot)
*I ended the relationship rather suddenly.
*I get a call from a lawyer saying that I've fathered a child with said woman.
*Lawyer says that woman is putting the child up for adoption.
*I called the mother and she confirmed this and stated that she didn't know she was pregnant until the moment her water broke.
*She claims that multiple visits to the doctor and multiple home pregnancy tests didn't reveal her condition (I find this detail a little hard to believe).
*Lawyer says that I am being asked to sign an affidavit of waiver of interest in the child.
*After much thought, I'm about 90% sure that adoption is probably the best scenario for the child.
*Lawyer sends two types of affidavits, one admitting that the child is likely mine and waiving interest and one denying that the child is mine and waiving interest.
*I have asked for a copy of the mother's waiver of interest to confirm that she has indeed given the child up but the lawyer says that it cannot be shared.
So, with all that laid out, here are the questions on my mind:
*Since I feel there has been some deception going on due to the falsehood about not being able to get pregnant and the claim that she didn't know she was pregnant, I am skeptical of everything I'm being told about this now. Could it be that she's not really giving it up for adoption and is seeking my waiver of interest just to get me to give up any rights so that she can keep it for herself without my input?
*If the above scenario is what happens, does my waiver of interest exclude me from child support duties? (I'm assuming not)
*Assuming that she has given the child up for adoption, am I obligated to waive my interest or can I just not pursue the matter while not waiving interest? Kind of like just letting whatever happens happen.
*If that 10% part of my mind wins out and I decide that I do want to claim the child, does the mother's waiver of interest still apply, granting me full custody or do both parties need to be in agreement?
I can't think of any other questions at the moment but I'm sure more will come up. Any info/advice would be appreciated.
