Possibly. The worry is that in the case of an actual assault the "recording" would silence or otherwise discredit the victim which I'm sure nobody is in support of. We could also argue that this exacerbates the problem of people being less likely to report sexual assault which already happens for a number of reasons. There are already problems with abusers who sneak by via technicalities, and the possibility of discrediting a legitimate victim and consequently crediting a legitimate offender are of course undesirable.

It's a difficult question because ultimately we want a fair system that gets to the truth, but I don't think that is always possible. Probablistically speaking any system currently possible will create false positives and false negatives neither of which are desirable.

Mandatory recording laws are fine so long as the limits of what the records can be used to imply are rigidly fixed. Accusations are free to make and there's no limit to how many can be made; we already know that some men in divorce cases have had allegations of sexual abuse against their own children made by their ex wives in an effort to get more money or custody.

It's okay to record accusations as long as we also record which are unfounded, lead to no action or are found to be malicious.

Cases of abuse are unactionable when there is absolutely no evidence to support criminal charges, which already requires shockingly little evidence to begin with.

I'm not sure I'm understanding what the point would be of keeping it on file at all-- it isn't wine and doesn't magically age to become more evidency with time. What's the endgame?
