TL;DR Ex-wife is getting ~$3k a month in alimony. She beats their eldest son so badly that he ends up dying of his injuries. "Medical error" was to blame, so she's only charged with aggravated assault and does 3 years.
The boy's father still owed alimony to the woman who killed his son, and the courts upheld her right to petition for alimony upon release.
EPILOGUE: I went digging through the internet to see what came of this. I was rather pleased with what I found.
New Jersey's lawmakers were justifiably pissed off that there was nothing the courts could do to fix this. Shortly after she got out of prison they pased a bill to "deny alimony to anyone convicted of murder, manslaughter, criminal homicide, death by auto, aggravated assault if the crime was committed after the divorce or dissolution of the marriage/civil union."
Finally, the father was awarded $2.4 million in damages for medical malpractice.

Swift law making in reaction to a clear and understandable moral ambiguity. This is amazing.

That started badly and ended exceptionally well.

The decision was issued in the case of Linda Calbi, who is serving a three-year prison term after pleading guilty to beating her son, Matt, on Aug. 17, 2003, during a violent argument at their home. He died hours later from internal bleeding and cardiac arrest...
Three years. THREE. FUCKING. YEARS. For voluntary manslaughter, possibly second degree murder. Three years. And she gets alimony.
If you've ever doubted the existence of the /r/pussypass , this should put any doubt to rest. What a despicable miscarriage of justice. Fuck "aggravated assault". She battered a toddler, and the toddler died. If the father had done this, he'd be serving 30 to life. "Medical error?" Bitch must've had a fantastic lawyer and one hell of a female-sympathetic jury.

Teenager. He was 14 when he died.
She'd been abusing him for a long time, and, based on the one picture I've seen, he was not very tall.

If it would have been the dad it would be 20 years and if he would be black probably life or death penalty.

Comeon man, it was just internal bleeding tots not her fault they couldn't save him.
She was a great mum, she turned up to school when it was revealed that her son was struggling. Of cause she was reeking of alcohol but that's not 'her' fault, her liver was just having a bad day. /s

but the charges were later downgraded to aggravated assault, based on expert reports that medical error contributed significantly to the boy's death.
By this logic you could unload a clip into someones chest, and blame it on the ambulance not getting there fast enough.
Wow, I really didn't think you guys could find something that would shock me anymore.

I thought the same thing. Without the medical attention the kid would have died I am assuming so anything the doctors did or did not do should be moot

Bad lawyer, and OP does not understand the law. Alimony is not child support but money paid for breech of contract.
OP hires me as an efficiency expert and we sign a contract which states that if I am terminated OP will pay me $3K a month for 10 years. I then kill OP's kid. That does not void the first contract.
A smart lawyer would have launched a civil suit for damages caused by me killing the kid.

You are missing the point sweet heart. If he never would have gotten married in the first place, alimony would have never happened. Bitch can kill my kid and still take may money. THE LAW IS FUCKED.
[–]krakosia-1 points0 points1 point 11 years ago (1 child) | Copy Link
is alimony really money paid for breach of contract?

Seriously what is the point of the legal system if it doesnt work
If i was him i would leave
[–]2mbillion0 points1 point2 points 11 years ago (0 children) | Copy Link
It also makes me sick she got three years. I did not know that if you severely beat somebody to the point of internal bleeding and the doctors made a mistake when trying to save his life that you could get away with murder.
This article shows the legal pussy pass on a number of different levels

Brutal and sad. . . .
Fucking sent shivers through me how the system continues to see women as little innocent flowers.
Like the article said, imagine if a woman had to pay her ex-husband after he murdered their son.
Oh fuck it what am I talking about.
That shit would NEVER happen. EVER.
