In USA the laws are from an older time when it was assumed by all male legislators that men were primary earners and women made the home. There’s a lot of background rationales but for communal property there is the idea that both spouses contribute equally to a marriage, even when only one works. Ideally, this is still true today. Also true today is that community property is genderless, he will get half your retirement just as well as she would. I encourage everyone to know the family law in their country before getting a state marriage contract and only get the contract if you’re willing to accept the risks in order to gain the benefits. IMHO you should not get married in USA to a person who doesn’t have a career path (stay at home parent is not a career) unless you’re willing to potentially support that person for life, until we make some major changes to family law. The state has no incentive to change these foundations of family law- spouse pays for spouse before state

Yes. Community property doesn’t specify genders. Neither does financial responsibility to a child under the law, which I find mind blowing that people don’t know that yes, women do have to pay child support when they are non-custodial parents/have higher income than other household (depending on state and court of course.) My own long term partner actually did not know that yes women are financially responsible to their children equally as men are. Due to various social and legal factors child support can become unfair to men when custody is being decided, or the man will have the higher income and will have to equalize out with her household. Or you could be like my mom and have an affair but not tell any of us until the support order and divorce is finalized and then get max child support and a good haul on property without the court knowing the full story. What is hilarious is that many women and mothers don’t seem to understand how family law works either (in USA at least), and will be dumbfounded when they end up having to pay child support. Again, I find this hilarious
Edit: another interesting kerfluffel that happens to people because they don’t understand family law is that gay marriage can fuck you as bad as straight marriage. Even when both spouses are male, one can resource grab the other because the family law itself is genderless (kind of). After gay marriage passed I saw a few people fuck themslevs over just because they were excited that gay marriage was finally allowed. Tricky ass state and media and public schools doesn’t say anything about the ramifications- they are happy to help you get married to whoever you want

I think any rich guy who's considering marrying today should be smart enough to do a background search on the woman. Find out how many times she's been married, how much money she owes (student loans, IRS...), any criminal record, etc.
I'm never getting married again, but I would do all of the above plus an pre-nup if I considered it.

Actually, I don't think it can happen that fast. My understanding (at least in California) is that half of gain or loss occurring during the marriage is all that would be split between the parties, and that marriages lasting less than ten years generally warrant alimony payments from either party to the other (more dependent party) for half the duration of the marriage. Property acquired before the marriage (and its gains or losses), or property acquired during the marriage from inherited funds remain separate (non-community) property. There are many subtleties that can complicate the simplicity of the preceding, but this is basically it as far as I have ascertained.

Bullshit. Even in shitty states, you only get 1/2 of the marital assets and you're only entitled to spousal support for about 1/2 the length of the marriage. Spousal support also terminates if you marry or mov in with someone else.

Your possessions and money from before the marriage are not part of the marital assets. There are also certain type of income that are excluded from marital assets, for example inheritance. So if a woman marries a guy for two months and then divorces him she'd get pretty much nothing.
Basis for statements: I got divorced 10 years ago. The house I owned outright from before the marriage, I kept. The money I inherited from by grandfather, I kept. (He died while I was married.) I still had to split everything that I save while I was married. (I say "I" saved because she has a shit job and spent more than she earned.) I also had to pay spousal support for a duration that was equal to half the length of our marriage. I had a pretty good lawyer and came out way better than what I feared going in to it. It still cost a lot. And now I know a little bit about "marital assets".
Anyhow, laws can obviously vary from one country to another so maybe in your country marital assets will include assets from before the marriage. But that really doesn't make sense.

USA, yea it doesn't make sense, but that is the law in most states if the judge even goes by them. Most judges will throw out the prenup as well even though its supposed to be binding. Another big thing is that you did it 10 years ago. In the current state of the US you wouldn't be so lucky.

"Marital assets" has a definition you can look up online. For example "Marital assets refers to all property acquired during the course of the marriage, regardless of ownership or who holds the title to it." That does not include assets predating the marriage.
Edit: I'm in the USA and that's basically the definition used in my state, and I suspect in all states.

There are a few examples of this in these sources. Its all a gray area especially if you as the husband earned more than the wife, equal division may leave you taking care of debt that was hers and having less money than you started with.

The problems in those articles related to how "owned before the marriage" is not always clear.
If A and B marry and A owns a house 100% paid off, then A will not split the house when A and B divorce. However if B pays to add a new foundation to the house then B can claim that some part of the house value is marital property. That is still consistent with the definition of marital assets.
Also, remember the case we're talking about is a hypothetical 2 month marriage, so most of these confusing cases are not going to be relevant.
Anyhow, the definition of "marital asset" is clear. My experience is that judges adhere to that definition. Your counter examples actually align with the definition. As far as I'm concerned this discussion is over. If you find yourself getting divorced, get a good lawyer. Good luck.

Not what it says, it doesn't say "some" of the house is marital property, it says that it would become marital property because the other person invested in it. If you add the spouses name to any of it despite it being paid off beforehand then it still counts, it doesn't make sense to do that in most cases but you need to realize how many people do it in reality. The whole its "ours" thing that women love to do. I am doubting how much you actually read of it considering the huge grey areas that are shown to directly counter the traditional definition of marital assets.
My experience is that judges adhere to that definition. Your counter examples actually align with the definition. As far as I'm concerned this discussion is over. If you find yourself getting divorced, get a good lawyer. Good luck.

I could say the exact same thing about you since your last experience with it was a decade ago, really doesn't matter to me what you think. Plenty of men have lost property that they have owned prior to marriage, just ask around the sub, its full of men who got screwed over by it.
