Presumption of innocence, along with it's two companion concepts due process and habeas corpus are indeed legal "constructs".

But they're also ethical concepts that inform our way of thinking... I say OUR way as in, people who have the capacity for rational thought. Believing someone to be guilty until they prove otherwise is just insanity.

All rape accusers are lying until there is a strong body of evidence to prove otherwise. No exceptions.
