Take a look at this link. Generally you are free to take out of joint accounts as you wish before the divorce is filed, but there will be limitations once it is filed, and for good reason. Maybe move half to a personal account, but I recommend consulting an attorney no matter what.

That's up to you. It's a bit of a gray area as far as ethics is concerned. It is your money.. how would you feel if your STBX did the same?

I knew divorce was coming so I quit putting things like money gifted on holidays or birthdays into the joint account, building a small stash.

Adding $20 here and there isn't anything anyone is going to balk at. Do you already take out spending cash? Continue to do so, but cut back on spending it.
