As a divorce attorney, you get paid more the longer things drag on. How do you balance the apparent conflict between quickly (and cheaply) getting to a reasonable outcome for your client and fighting to get "the best" outcome, though it may be hugely more expensive and damaging to any post divorce relationship between the parties?

I live in NY, my kids are both over 21 (one had moved out, one still lives at home), the house is paid off, my wife makes more money than I do, she has a larger 401k than I do, we've split everything 50/50 thebwhole marriage (27 years). What can I expect in the settlement and can she get more than me if she (thinks) I'm the one who's causing all the friction in the marriage? I know that it takes two people in a marriage to help it succeed or fail, but if she feels it is my fault will I be penalized? Also is it possible since she makes substantially more than me per year that I could see compensation on the other side? Thank you.

Contemplating divorce. Wife has never treated me well. I could even argue verbally abusive. She makes more than I do, I’d be moving out. Is here a percentage or something to calculate how much I’d have to pay her and the kids so they didn’t have to move?
