Hey - i'm in the process of separating from my wife, who filed for divorce in February of last year. We went to court and the judge granted terms that were favorable to me (I live in SC, where you have to be separated for a year before the divorce is final) and she had a change of heart and convinced me to take her back. Unfortunately, all of the promises she made to fix our problems weren't real and we're back where we started. Tonight she started a fight over demanding to see a text on my phone in regards to a play date i set up for my 7 year old daughter. I refused to give her my phone so she snatched the phone and ran down the hall where our two children were playing with her granddaughter (she had her first child at the age of 18 and her daughter had a child early as well). I have this on tape. I ended up calling the police as she was screaming and name calling in front of the kids, and in the past this has been a precursor to physical violence.
The cops came and she left after convincing the kids to go with her. Now that she's out of the house, do i have grounds to file? She agreed to move out after Christmas previously, and is expecting money from me in order to make that happen. I'm the primary earner in the household but she also works full time, makes about $30K less a year but her credit is shot. It would be great to have this be the last time she does this in the house - any legal advice you can offer would be greatly appreciated.
