It would be rape if it was a drunk woman and a sober guy who was not into it too. The whole crux of the argument for intoxication supplanting consent is when you are too drunk to do or say anything. This man had an agenda.

Being drunk is not an excuse. I have been drunk plenty of times and when a woman was not into it I did not continue. And there have been plenty of times where I was drunk and she was into it. Or she was drunk and into it.

Investigators were informed these texts existed, but never asked for them:

Like wtf, you're trying to imply the guy is the victim here? I get it if you had shown a post with the genders swapped that you're angry, but if he forced himself on her in this situation it is just rape.

There is probably some degree of nuance in this, but I feel you're indirectly implying he didn't do anything close to rape, which (assuming the story isn't a complete lie) is wrong.

I get that, but this post here is shit for trying to tackle that issue.

Like, what exactly are you trying to imply with this story here? That it's probably false - she raped him? Or you're implying the existence of a similar story with genders swapped, where the guy is punished? If it's the latter, you should've brought one up for side by side comparison. Right now it just looks like denial of rape.

Edit: My point is just also - be careful about getting into a mindset of always assuming the woman in the story is at fault, because then you'll just end up doing what feminazis are doing currently.

While common, that does not make it true. I see what you are saying though. I have heard that argument before. It devolves into a sexist exchange after that. A lot of these fights boil down to convenient double standards.

He's not guilty of rape because "penis" - he's guilty of rape because he forced someone to have sex. It literally says it in the screenshot: "he forced OP to have sex".

It's a highlight of a double standard. Intoxication does not remove criminal liability; however, in situations where an individual is intoxicated, the male is presumed guilty if the female is intoxicated, and the female is presumed innocent even if she was not intoxicated and the male was intoxicated.

Without the original post, I can't say if the comment is truly rape denial, or if the original post is a regretful sexual encounter with her intoxicated boyfriend being posed as a false rape allegation, or if it truly is a case of rape
