Always found it strange.

When you drunk drive, you're responsible for your actions, will get arrested and put in jail, go in front of a judge and get your licence suspended or removed.

When you drunk fuck, you're somehow a complete victim. None of your actions have any importance, even if you agreed to the intercourse it's somehow not valid anymore. Even if you instigated the intercourse you are a rape victim.

Talk about non-sense... How is it supposed to work? Are we supposed to gave her a breathalyzer test in front of an sworn agent to prove she has zero alcohol in her system before preceding to the bedroom?

But if being drunk is the same as being poisoned, why a drunk driver is responsible?

Why isn't it the fault of the person who gave or who sold the alcohol (the poison in your analogy)?

Or if you drink with friends or family, why are they not charged for letting you take the wheel?

See, that's the kind of double standard which bother me...

And your analogy doesn't make more sense because if you're drunk and decide you want to have sex you're not forced to have sex. Just like if you're drunk and decide to drive, you're not forced to drive.

But I agree, if you're drunk and are forced to have sex (you say no, he proceed anyways) then it's rape. The same way if you are drunk and forced to drive (at gunpoint for instance) you're not responsible either.

This would lead to state, where all the alcohol is suppose to be banned. But we humans like to destroy our body a bit. Since altering brain is a bit fun. So selling poison is legal currently. Howevere manipulating people using various substances, is not.

About friends and family. If they pressure you to take the wheel, they can be charged.

Same with sex. The guy might state "nah i did not pressure her", but if he was the one in the action, he has high level of motivation to do that.

Family and Friends, most likely have no interest of you driving drunk. There is no motivation there.

So it boils down what is more likely. Who pressued who. What are the motives.

And damn, why to take the risk and why somebody wants to have a sex with person who is drunk. It is way better when you are sober and in safe Environment.

Respect people. Even if they don't respect themselves. Show care and love.

Edit: and the drunk person, if he/she would masturbate on public place and get caught. He/she would get charged as if driving the car.

With drunk sex, if there is 1 sober person, then its suggest it might have been planned out by that person.

I think we don't have the same premise.

What are you considering as drunk? I mean there's a difference between being passed out drunk and being jolly drunk after a beer or two. Passed out drunk means obviously no consent can be given, because you know one being passed out...

Do you consider that after drinking any amount of alcohol a women cannot consent to sex? What about women drinking alcohol for the purpose of having sex while feeling also jolly drunk? (You know, feeling embolden by the alcohol state for the instance, like people feeling like king of the world while drunk).

Or do you think women are never the one wanting sex? Like they are just passive participant never enjoying?

I mean, I'm not a party guy, not at all. I'm a 37 old dude that only had two girlfriends ever, and only had sex with those two women ever. I was with the first one for 7 years, and I'm still with the second one, we're married actually for a few years now. The point being, we have also sex when alcohol is in the mix. Happened when I was sober and my wife had a few drinks, and actually drinking alcohol makes her pretty kinky and may I say wild. She's the one jumping on me when that happened, not asking my permission before going down and starting running her mouth on my privates. She's the one being totally aroused by her jolly drunk state and loving marking love while feeling that way. Am I a rapist then? And what about the times when she's sober and I'm the one drinking alcohol since it also happend a few times?

You are giving an intresting scenario here. And I have no idea how they are handled legally, so I am going to simply give my view on that.

I think it should depend from case to case and what was the motivation.

If its your wife, who wants to go to that kinky state, then I think it should be totally ok.

If it's you, pouring her more drinks to her, so she should go to that state, where you could experiments the new depths of kinkyness, then you are using her.

By the law, I see that it will be hard to proof, what is the actual motivation.

Additionally, I think cases, where it was "happened once in party" vs "we have been together for years" should be handled differently. Because if you are toghether, most likely both of you have the motivation to have sex.

So there I would raise my eyebrow, if wife gets drunk, then and only then the heavy bdsm stuff is taken out. Smells like someone is taking advantage of someone.

But if it is the regular her and you guys have talked about it, and each time you guys check with each other how other is feeling. Have fun.

But if one party has some shame involved, then stop.

Like my view, sex is kinky and holy. By the all times, you should consider the other person. And before you do something, one should know the other person enough, to verify that her/his consent is a true consent.

If it is or was, there will be no report, but " thank you," and "when is the next time?"
