The answer is in understanding WHY the court system is like this. Women engender more empathy than men; judges and mediators simply follow this bias ( to the harm of families and societies ).

So to answer your question; it's whoever can garner the most sympathy from the mediator/judge. Who ever can spin their story in such a way as to generate empathy.

It's a question I asked a long time ago, also who wins when two lesbians divorce.

Generally, I'm still not sure, but I read an article not long ago about a lesbian couple that got divorced and one of the women was very angry that she had to pay the other. I don't recall if it was CS or alimony though. I have no idea how this was adjudicated.
