Now we need to find laws that somehow treat women as lesser beings.

We surely don't have problem finding such laws treating mess like lesser beings, the whole legislation around violence lies, for instance, is not gender neutral, so are many rape definitions.

Not even feminists really want the ERA anymore; it's not radical enough and it wouldn't allow them to hoard the special ladies-only freebies which are so precious nowadays.

if I remember correctly, and it ha been a while, the amendment in its most recent form had a 'this will not be construed to outlaw any special privileges currently enjoyed by women' clause.

Here is the text:

  • Section 1. Equality of rights under the law shall not be denied or abridged by the United States or by any State on account of sex.

  • Section 2. The Congress shall have the power to enforce, by appropriate legislation, the provisions of this article.

  • Section 3. This amendment shall take effect two years after the date of ratification.

Section 1 should give us the ability to sue over the gender sentencing gap, circumcision, selective service, and any number of other things.

The ERA would be a godsend to the Men's Rights Movement.

In 2018 it would be hard to sell the stipulation that women retain special privilege. There would be no barrier to 50/50 physical custody.

I guess what I was thinking of was "the Hayden rider" you'll find it a bit further down the wiki page.

yes in the form you cite here it would be a very good thing, and besides the obvious, it would put armies of lawyers to work correcting injustice instead of chasing ambulances.

I hope I can be forgiven for being, still, a bit skeptical. Riders and policies and interpretations and exemptions all said and done, any law passed seems only to boil down to 'lock up more male citizens'

And yet the 1964 Civil Rights Act, which forbade racist and sexist discrimination explicitly and in exhaustive detail, was turned into Affirmative Action (which the text of the act explicitly makes illegal).

A half-century ago, while championing the Civil Rights Act, Senator Hubert Humphrey insisted, "I will eat my hat if anyone can find language which provides that an employer will have to hire on the basis of percentage or quota related to color, race, religion or national origin."

For years I thought Hubert Humphrey had died just to avoid that hat eating, but reading the 1964 CRA proves he was right.

This is the legal framework in which the ERA would operate. You're optimism needs a reality check.

EDIT: The original CRA only forbade racism, Jimmy Carter added 'sex' later at the request of feminists.

And since all of the claimed benefits of the ERA have already been added by statute, what additional benefits to women could an amendment like this bring? When you ask this question, they're sort of short on specifics.

With CEDAW, its proponents really are playing a double game though. To one audience, they say it'll only be symbolic and will change nothing, to another audience they claim it will flood the court system with lawsuits and finally teach those pesky mehnz a lesson.

I hope this leads to women facing conscription and joint custody. Honestly, if we pass the ERA, I feel like it would be awesome. Think what you want, but I really do have faith that it might help us.
