The nation’s highest military court has thrown out the 2012 rape conviction of a Coast Guard enlisted man because admirals and prosecutors packed the seven-member jury with five women, four of whom held jobs as advocates for victims of sexual assault.

Okay, the title implied that a women-pack court overturned his conviction. Rather, his conviction was overturned because holy shit, this is like packing a jury full of KKK members at a black man's trial.

Indeed. In my post a few moments ago (https://www.reddit.com/r/MensRights/comments/7vh242/metoo_the_inevitable_reign_of_terror_as_gender/), I outlined the necessity for collectivist groups - including feminism - to hold on to power via tyranny. The #MeToo panic is exactly analogous to the Reign of Terror during the French Revolution; this here was a Stalinist show trial.

The key to this is not only was the panel packed with female jurors, but four out of five of the panel members were former victim advocates with the only explanation that they illegally considered gender and chose women to be on the panel for a sexual assault case for "diversity."

This case is on the heels of reported cases where the Navy TJAG advised a Convening Authority against dismissing a conviction because it would "paint a target on his back." [Likely from Senator Claire McCaskill who veto'd a promotion of LTG Susan Helms, or Senator Gillibrand who would use the dismissal as fodder for her arguments that Commanders should not be responsible for convening Courts-martial.] Also, the AF TJAG made reference in a Court-martial to Gillibrand in an AF sexual assault case that caused a reversal of a conviction.

Everyone should understand that prior to "The Hunting Ground" the victim grievance industry started with "The Invisible War" to highlight the military's stance on sexual assault. The good news is that, based on my experience defending Soldiers at Ft. Benning in a civilian defense counsel capacity, panel members are beginning to reject the training they receive about "believing the victim." During my last Court-martial 8 out of 10 raised their hand during voire dire to state that they believed false allegations of sexual assault are a problem in society in general, with 4 of them believing that they are a problem in the military.

During that Court-martial, my client did not take the stand, the alleged vic had a huge motive to fabricate the charges, CID was shown to be dishonest, and my client was acquitted of all the sex charges. So, the pendulum is swinging the other way.

What is amazing in the trial reported in this article is that the Coast Guard Court of Criminal Appeals, Military Judge, Staff Judge Advocate, and Trial Counsel did not see the problem with stacking the panel. That is FOUR layers of personnel who should have taken steps to protect the accused's right to a fair trial, yet they allowed or affirmed the decision to allow this Servicemember to be tried by this stacked panel. At least one of them should have said, "Hey, uh, I don't think this panel has been fairly convened." The fact that NONE of them did is great cause for concern.

I have no military legal experience. Can the advocate for the accused question the tribunal at the time, or must this wait until appeal?

Prior to the Court being "assembled," voire dire is conducted by the Military judge, the prosecution, and the defense, both as a group and individually. Each side can object to (challenge) a panel member serving "for cause" which I believe the defense counsel in this case did. After for challenges for cause are made, each side gets one free pre-emptory challenge for whatever reason they want (as long as it does not pertain to gender, race, religion, etc.)

It doesn't say that. Military members have access to specialized free representation. AFAIK, it's a little better than getting a public defender so a lot of military folks use it.
