This will allow single mom's to go to grandparents if the father is not able to pay.

In this case, father is dead.

I know. Think broader.

Next they will go after neighbors.

Or strangers who smile at the kid.

The grandparents acted as guardians for a period of time and have court appointed visitation rights. If they want the same rights as parents why shouldn't they be on the hook for child support?

The grandparents acted as guardians for a period of time

Holy hell, what a mischaracterization. You're leaving the part out about how they were the temporary EMERGENCY guardians in the immediate aftermath of their son's wholly unexpected death in an automobile accident, for 8-9 months while the fallout got handled. After which, Mom took over, which was all but guaranteed to happen.

You know that their son WON his custody case, so the children were living with him and saw the grandparents almost all the time, prior to that accident, right? The court making them the emergency guardians made sense, given the context.

have court appointed visitation rights

Access rights are not the same as guardianship or custodial rights. Don't conflate the two.

If they want the same rights as parents why shouldn't they be on the hook for child support?

They don't want the same rights as parents, though, do they? They want to be able to visit their Grandkids.

The federal government passed Bill 34 precisely because so many Moms were playing gatekeeper with the kids and cutting both their ex husbands and his family out of the kid's lives that they felt that a federal bill was necessary to keep this degree of assholery down to a minimum. NOT so that the same assholes could turn around and sue those grandparents for child support, under threat of cutting off the contact that the bill was supposed to help guarantee.

Guardians should pay for those children. That's it. It sucks that she's now the only guardian, but that would be the case if she and this man were still married, too. She's not 'out' anything because he died while they were divorced.

[–][deleted] 1 point2 points3 points 8 years ago (6 children) | Copy Link

No. I'm guessing they have visitation because the woman tried to cut them out of their lives , normal grandparents want to see the kids from time to time. They WERE guardians for some time they aren't now.

She had a contract with the man, not his parents. Her meal ticket is gone and she wants another which is odd because in the US all men paying CS or alimony are required to have expensive life insurance in case he dies.

Also This opens up a huge door for every other divorce . What if a ex husband doesn't make a lot of money, get child support or alimony from his parents to make up the difference.

She just looking for free money.

You said you're guessing, which is exactly it. You dnt have the facts. Period.

[–][deleted] 0 points1 point2 points 8 years ago* (4 children) | Copy Link

They wouldn't have to sue to get rights if the wife was willing to let them see the kids. How dense are you?

[–]yokohama_mama 1 point2 points3 points 8 years ago (0 children) | Copy Link

Not dense enough to jump to conclusions about a case I know nothing about and then go off on some barely related tangent.

[–]yokohama_mama -1 points0 points1 point 8 years ago (2 children) | Copy Link

Also? Sometimes shit grandparents sue for visitation and sometimes they sue as a shitty power move.

I mean, you frequent men's rights forums all the time, don't you? Don't you guys accuse women of abusing the legal system as a means of control all the time? You might notice that the grandmother is gasp a woman, so doesn't it stand that her suing for access was a power move on her part?

[–][deleted] 0 points1 point2 points 8 years ago (1 child) | Copy Link

Yep that's it. You won. Don't have time to talk to crazy women.

Frankly, I hope they lose in court. It will only set another bullshit precedent that will move the doomsday clock closer to midnight.

Let it all burn.

For fuck's sake.

This is the best tl;dr I could make, original reduced by 87%. (I'm a bot)

Two North Bay grandparents are being sued for child support in a case that could be precedent-setting.

Grandparents are very occasionally required by court to make child support payments when they are determined to "Stand in for a parent," which in most cases occurs because they have custody of the child.

Schuman says giving grandparents legal standing and the ability to argue for access orders does open up the door to them being forced to pay child support.

Bad situation Will in some cases drive grandparents away or they will be real careful

These grandparents had had previous custody thru a social agency I think was mentioned in cbc article That may have helped to facilitate this

Actually a guy could bring an order as well
