How old is your son? What does your son say? If your son says he doesn't want a relationship that is not based on your influence, then have him speak to the Judge. I've always had my best results when the child told the judge who they wanted to live with or wanted to happen. Depending on your jurisdiction, this could happen in the privacy of the judge's chambers.

Sometimes, a kid will want to have a relationship for reasons that are bad for him. So, say Aunt's boyfriend lets him smoke weed, which is why he wants to be around Aunt's BF, then you might need to be the one who informs the judge if Son is going to tell the judge that he doesn't mind hanging out with Aunt's BF.

Reading the title led me to believe that you were trying to limit contact only at the custody hearing. It reminded me of my divorce proceedings. My ex-father-in-law is loaded with cash and as a result I realized that my money would run out before there money would, so I taught myself everything I needed to know about family law in California. After witnessing the injustices in family court, I'm sorry to say that we do not live in a truly free country where justice is blind and fair. But I regress to my situation with my ex-father-in-law... Every time we had a hearing he would be present with my ex-wife, comforting her... making her feel as if restricting my time with my daughter was a valid and good thing that she was doing to me and my little girl. Well, he had another problem and that was his desire to constantly heckle me from the galleys. Straight up making faces, blurting out incoherent idiocy. It got so frustrating that I decided to call him as a witness for every future hearing. By calling someone as a witness, they are instructed by the judge to wait outside the courtroom, so as not to poison the well. I never needed to cross examine him and he would likely lie through his teeth, but it gave some satisfaction in a very imperfect and unjust system. Subpoenas are free for the self represented litigant. Problem solved.

As far as your situation is concerned, you could have argued that the RO stay as is, protecting both yourself and your son. I'm concerned for you that you have missed the boat on this one since a judge already ruled that the permanent restraining order was for your sole protection and did not extend it to your son. It might be a tough sell but you will likely have to follow up with a separate restraining order perhaps with a declaration stating why you feel it is necessary. You would have to serve them on the person being restrained and provide copies to your ex and her attorney. The court will likely assign a different court date than your first custody hearing. You could ask the clerk if it is possible to have the issues heard at your first custody hearing, but we're talking about govt employees here... I thought restraining orders need to be heard in a timely fashion...? You should check on that in your state. Perhaps you might be able to have the issue heard before your first custody hearing if that is the case.
