Under the law, a child born abroad to an unwed American mother automatically becomes a U.S. citizen if the mother previously lived in the U.S. for a period of at least one year.

In contrast, the child of an unwed father can't become a U.S. citizen unless the father has lived in the U.S. for a continuous period of five years, two of them when he was over the age of 14.

fyi it got changed so women now share the men's standard as ginsberg says the women's treatment here was "the exception to the rule". So no, not even table scraps actually.

hmm. Ginsberg's position here is actually interesting as it's signalling a more conservative outlook towards sex-based civil rights and that some entitlements women enjoy above men may be rolled back over coming years unless Congress chooses to extend these same entitlements to men. Frankly this shouldn't be TOO big a problem as when exposed to the genuine concerns of mras many normal people tend to go "oh hey yeah we should totally change that law to be more equal wow".

So many "table scraps," "lulling," et cetera comments. Come on, guys. Yeah, it's a minor victory, but it's a victory nonetheless. Maybe this will be a step towards getting some bigger victories in the future. Why can't we just be happy about this?

I'm not American so I don't want to tell you what your citizenship laws should be, but:

It's a bit of a shame to have this result in a removal rather than extension of benifits

It is therefore to be said that as of this case the present requirement to pass on us citizenship to a child (bourn overseas) of one American and one Alien is that the American parent had 5 years residence and two years after 14, regardless of marriage status and gender of the America parent

If you believe this is unfit (for instance if you would like 1 year for all bastards) contact you congressman and senators using this case as justification for action
