A New Zealand judge has dismissed charges against a man who posted semi-naked pictures of his wife on Facebook. The judge decided there wasn't enough evidence to prove she had suffered harm and the case was dismissed.

Come on, this is a court room and not a court of public opinion.

You HAVE to show damages in some capacity other than just hurt feelings. If you didn't even take a day off of work, and there's no indication of reduced performance, or impacted social relationships, what can the judge do? If he rules solely on your feelings, then every last person filing one of these claims is going to be "distraught, upset, and suicidal" in short order.

I mean it is still a shitty thing to do. I understand the judges stance and honestly as long as it showed nothing more than what a bikini would show it is a push. However I do think he should be removed from facebook by facebook and all his friends should disassociate with him

That to me sounds like the judge believes the law is unwieldy and using this case to make that point.

The judge said more detailed and specific evidence from the defendant as to her reaction and feelings to the photos were needed.

So in future people trying to make a complaint under this law will rant extensively on youtube or their blogs about how hurt their feelings are.
