If her story is true, then it is attempted rape, not molestation.

Her reaction to the incident is what is suspect. They were in a sexual relationship and were sleeping next to each other, so it is not at all likely that she would cower against a wall when she woke up, or be traumatized by the incident and need counseling.

On the other hand, if she has a text message, maybe the guy did do it thinking she would wake up and be ok with it. And this is the dangerous territory for him.

The reality is that initiating sex with a partner in their sleep or vice versa is like doing a rolling stop on a right turn. Everyone does it and only a few get stopped for it...but when they do it is actually for another reason that the cop doesn't say (ie he thinks there are drugs in the car).

The fact that we lump the case where a man breaks into a woman's house and rapes her with the case where a guy gets frisky on a staycation is an insult to the woman in the former case.

They might as well just fast forward these latter cases to the civil court. It would save everyone a lot of time and get straight to the point.

Yeah, if what she says is true, don't even bother trying to take sides on that, by all accounts that's attempted rape, especially since she was asleep at the time and unable to respond.

Let's not reduce ourselves to the insanity of feminists by trying to constantly side with anybody that has the same genitalia as us.
