Not surprising. Why do they all get away with it?

[–]HeForeverBleeds 5 points6 points7 points 10 years ago (5 children) | Copy Link

Because too many people don't see women raping children as women raping children. They see it as a poor, troubled woman making a bad decision--in this case because of her marriage breaking down, that insensitive husband!--and one that too many believe is actually harmless, because boys are never really traumatized, right?

And boys are treated like men who can handle it like a man.

Meanwhile on another post today, everyone is for protecting the girl, no one saying she can handle it like an adult like boys are expected to do.

(ranting)

In the eyes of society, the "child" status of boys goes away at about 10 years old. For women it goes away a about 30

Unless of course said woman over 30 commits a crime. Then she automatically regains her "child" status again so that the defense can say it wasn't her fault and that she was too immature to understand that what she did was wrong

"This is clearly very serious offending."

Clearly you don't think so, Judge Cotterell

And just a few months earlier https://au.news.yahoo.com/vic/a/31100568/no-jail-for-vic-woman-over-teen-sex/

This is very significant. About a decade ago there was this big watershed moment in Victoria where it seemed that the courts would finally start sending female child rapists to jail. http://www.theage.com.au/news/National/Sex-offender-teacher-weeps-as-she-is-jailed/2005/05/05/1115092625987.html

Justice Callaway said the failure to jail Ellis had "unintentionally violated the rule of equality before the law, including equality of concern for male and female victims and equality in the sentencing of male and female offenders". "Nevertheless I have concluded that, even now, the respondent must be required to serve part of her sentence in prison. Unless that is done, the principle of equality will not be observed."

It seems the courts in Victoria have gone back decades in their lenient treatment of female child rapists.

It's also interesting that the two flagship newspapers, the Herald Sun, and The Age, are both not reporting on this.

Oh hello! http://pokiepleasures.com.au/afghani-rapes-teenagers-female-judge-barbara-cottrell-gives-him-a-rap-over-the-knuckles-the-age-61/

An article in the Herald-Sun April 5, 2010, referred to a case where Judge Barbara Cotterell’s “instincts” were ruled to be well wide of the sentencing mark when she dealt with a man who indecently assaulted two boys aged 11 and 12, and raped one of them, while a tenant in their father’s home.

I'm not surprised that this didn't stick. I've been following a similar series of appeals happening in England/Wales under the current attorney general. I have done this ever since I read an article where one of these women who pleaded guilty did so because she was promised by the crown that if she pleaded guilty she wouldn't go to jail. Another woman a few months later, who was later found innocent, was told that she was tempted to plead guilty despite not doing it because she was given the same offer. Following all these stories, I noticed that, without fail, women who pleaded guilty to sexually abusing teenage boys would not receive jail sentences. I'm convinced that offering this deal to women was the prosecution's standard operating procedure.

The point I was trying to make though is that, since taking over in late 2014, the attorney general has appealed every single suspended sentence I could find given to a woman for sexually abusing a boy under 16. Despite being successful in getting jail time for 5 out of 6 of these cases, all of which happened in 2014 or 2015, the first case of a woman sexually abusing a boy, pleading guilty, and still going to jail in England/Wales I could find didn't happen until two weeks ago. This despite 5 successfully overturned sentences, with appeals judges making remarks like "this should reassure the public that teenage boys have a legal right to be protected from interference by adult women" every time. In one case the appeals judge even criticized the lower court judge who said the sentencing guidelines are brutal, and said "I wonder if she would have thought they were brutal if it were a man and a 13 year old girl". Yet still it didn't seem to really set a precedent (until the most recent case, maybe things are finally starting to change).

It seems those precedents are only useful if you have an attorney general actually willing to appeal sentences that don't follow them.

[–][deleted] 0 points1 point2 points 10 years ago (2 children) | Copy Link

Yes, the UK has recently stood out as a country that both prosecutes and jails women for perverting the course of justice in false rape cases, and jailing female child rapists (even though the sentences are extremely short as the recent case of Adam Johnson has showed).

It seems those precedents are only useful if you have an attorney general actually willing to appeal sentences that don't follow them.

And a media willing to report and agitate against it.

Interestingly, in that 2005 case I referred to, the Melbourne newspaper The Age published an editorial the next day titles something like "Equality taken too far" (from memory, can't find it online), basically arguing against jailing women in these kinds of cases. It seemed the consent offered by a teenage boy was very different to that of a teenage girl (even though we are told girls mature much faster than boys). And years later, women are still avoiding jail and few newspapers in Australia are reporting on the phenomenon. This one from about a year ago: http://www.abc.net.au/news/2015-02-19/teacher-avoids-jail-for-sex-with-pupil/6151428, the boy was 14 and she was 36 and his teacher. It's about as serious as a single case of under-age sex could get, but instead of being treated like an adult responsible for her actions, she was "sad and lonely" and may not have understood her actions were "inappropriate". Not criminal, inappropriate. A couple of newspapers reported it, none engaged in commentary or tried to provoke outrage. And the year before, one of the worst cases ever reported: http://www.abc.net.au/news/2014-06-06/single-mother-avoids-jail-for-sex-with-15yo-boy/5505318. This was rape, no question, they jury accepted the boys version of events that she jumped on him when he was sleeping - did plead not guilty and claimed nothing happened. They jury basically said, she raped him, but we won't convict her because...maybe they don't think boys can be raped. The boy was seriously affected, but she still walked free. A man would have got 10-15 years for that. But if you really want your blood to boil, this remains the great stain on Australia's tolerance of female child rapists...and this case is still being censored and covered up by the Australian mass media (the acquittal at least): https://www.change.org/p/the-hon-greg-gregory-eugene-attorney-general-of-new-south-wales-appeal-the-acquittal-of-cassandra-leigh-johnson-of-abusing-young-boys

And a media willing to report and agitate against it.

This is so true. I hate to admit it, but the dailymail and the other British tabloids using every one of these stories as cheap clickbait is really great in that it at least draws attention to the issue in the UK.

I mean, I really hate to admit it. With titles like "Schoolboy seduced by disgraced teaching assistant reveals they had sex 50 times - and she told him he had made her pregnant" (source) it's clear they're just using these stories as clickbait crap and couldn't give a damn about getting justice for this kid. But in doing so they get a story about a boy talking about how his abuse left him "scarred for life" and was disgusted by her lack of punishment some serious publicity...609 comments and 27k shares, probably 100k+ views...with a lot of people pointing out the double standards in the comments...Then the sentence gets overturned. Serious sites like the BBC rarely if ever publish these stories, but the Dailymail and the like can't seem to get enough of them.

And reading through all those links made me irrationally angry, especially the one where the boy was basically violently raped and still no justice. We're making some progress in the US and England/Wales, and we had some in Canada (with mandatory minimum sex crime sentences, although as I posted today a judge is going to try and get them ruled a human rights violation so he can spare a woman jail), but in places like Australia, New Zealand, and Scotland it seems like we're making little or no progress.

At least I found a few Australia cases where the women actually went to jail! (if only for a very, very minimal time):

[–][deleted] 0 points1 point2 points 10 years ago (0 children) | Copy Link

If that last one didn't result in jail there could have been riots. That's if anyone reported it. The sentence was still pathetic - 3.5 years for a 40yo woman to extensive abuse a 12yo boy. If it was a man and a girl he would have got at least 10 years at least.

What shocks me in the total media blackout, not so much on the reporting of verdicts, but on commentary and analysis.

What makes it so strange is there was this big storm in 2005 with that teacher Karen Ellis...it was a big deal and everyone was talking about women getting away with it...then it's like the law did a deal with the media where they go back to handing out pussy passes, and the media will barely report it, and totally censor any social debate on the issue.

If a man got away with it like this women do...the media would be jacking it up on the front page and screaming misogyny. All I can say is thank God for the internet - and there is a reason why SJW types hate it so much, it takes away control of the narrative from the mass media that seems to always play into their hands.
