The problem here is that statutory rape is what is called a "strict liability" offense. It is the the harshest standard, because no amount of good faith or due diligence can protect the accused.

Many other crimes have an element of intent. For example, if you accidentally kill someone, you have not committed murder. Murder requires intentional harm. But for statutory rape, there is no requirement that you "intended" to have sex with an underage girl. The only question is whether it happened or didn't.

It is so sad what happened to this young man. I hope he finds justice. For the rest of us, please be careful and remember that there is no defense of she lied, I saw ID, I met her at a bar, etc.

I would try to put pressure on the governor/mayor for a pardon. That's the person who could end this irrational fiasco immediately. Also, laws need to be changed to hold dating websites/services legally liable for verifying the ages of their members. They are the ones facilitating these life ruining interactions and they walk away with complete impunity.
