They need to be suing Jackie directly as well. Rolling Stone is responsible for bad journalism and should be accountable for that, but Jackie is the ultimate source of it all.

Rolling Stone has deeper pockets, so suing them makes sense in that respect, but Jackie herself needs to be held accountable for the damage she has inflicted on many many people. She destroyed fraternity chapters, she harmed many individuals' reputations, she marginalized the suffering of actual rape victims(and possibly caused some true victims not to speak as they may not want to be viewed as liars like Jackie), she took the spotlight from stories based in reality, she harmed UVA's reputation, and overall unleashed a fury of negativity.

The extent of the damage she has caused can not be easily be measured, yet she has not been held accountable for what we know to be lies. Very few publications even dare to publish her name, much less acknowledge the ~~criminality of her false police reports,~~ libel, and slander. (correction, the libel, slander, and defamation is not a criminal issue it is a civil issue, Jackie also never filed a police report and refused to answer investigator's questions)

Allowing Jackie to spread her falsehoods with complete impunity sends a message to young women everywhere that if you falsely accuse others of rape and get caught, you will get away with it. You will be protected from even having to take accountability. You will be able to enjoy anonymity, a luxury that victims of your false accusations were not given. You will not pay the legal costs of your actions, those who believed you and provided you a platform will carry that full burden.

This is simply not something which should not be tolerated.

But the gang-rape allegation is defamation per se, a statement against someone’s reputation so egregious that courts assume damage.

Rolling Stone Is In Deep Trouble Phi Psi waited for the Colombia report before they confirmed they would take legal action. That was logical and wise. Most commentators think Rolling Stone would be wise to settle as soon as possible. I agree, but I do not assume settlement is on the table.

Additionally, I don’t assume Rolling Stone can be wise. Their recent history suggests otherwise. It isn’t just Rolling Stone’s mangling of this story. Also this week, the Boston Marathon bomber was found guilty on all charges. Rolling Stone had featured him as a heartthrob cover in the months after the bombing.

I hope this sets a stronger precedent for more falsely accused to litigate. So many times do I hear an innocent defendant say they just want to put it behind them. Why not get a little justice first?

Twenty years ago if you told me that I would be siding with a fraternity I probably would have laughed in your face. But maybe not as I like to think I have a good sense of justice.
