This declaration just goes to show prevalent is the problem of false rape cases in the country. More than half the rape cases are fake according to statistics in various states.

the good news is that in India, one court did declare it (maybe). I have not found those words, as a rule, in the court's voice.

In the US, they have not.

Title is misleading.

In many countries and I think India might be one, yes you can rape a woman who consents to sex. This used to be the case in the USA too. In fact the Mann Act is still on the books which made it a crime to cross a state line with a woman not your wife, that you intended to have sex with (even if she consented).

Various laws in various countries make it "rape" or some sort of sexual crime, to have consensual sex with a woman if you aren't married to her or pretend you're going to marry her and then don't or similar.

In this case the woman made this sort of charge but the judge seemed to think that she was not covered by the law because she had already been married and had kids, so she wasn't pure and virginal enough to be covered.

A sessions court recently acquitted a man of charges of rape under the pretext of marriage, taking into consideration the 36-year-old complainant's matured age and her marital status.

The judge did not mean that in general consensual sex is not rape.

She alleged that on November 9, 2011, at around 10pm, the accused asked her over to his house. He asked her to marry him and have a sexual relationship with him. When she said she would think it over and was about to leave the house, he shut the door and forced himself on her. He assured her that he would marry her and requested her not to talk about it as it would affect his reputation.

If her allegation is true, then she was raped.
