In my case, my exwife got 50% of my 401k (no alimony, and I kept the house and car, made out like a bandit).

Anyway, the judge's decree (we had to go to trial) stated that one of us had to have the QDRO created and split the cost 50/50. I had it created and then submitted to the court and then tot he 401k management company. Just so I could be done with this crap.

My ex's attorney processed the QDRO. It didn't get started for a month after the divorce had been finalized by the judge. I know because the plan administrator contacted me about it. The money was transferred out of the account about two weeks later.

So check your paperwork about who you agreed would do the paperwork. It's usually one of the two attorneys. I assume they've been paid already to complete the QDRO? That'll be a separate scope from the divorce billing.

Once I had the divorce decree I sent it to our HR rep (my 401k is through my employer). She sent it to the lawyers. The lawyers needed my ex-wife’s personal information (I believe from the last time we filed taxes so it included her name, date of birth and SSN) as well as her e-mail address and phone number. I don’t know exactly how long it took for her to get the money she was “entitled” to, but I recall seeing it leave my account a month or so after I gave them the information.
