Whose house?

If it's in your name, you can ram down the door if you want. You don't need a petition or her permission. You can change the locks yourself and move back in, then call the cops as she pulls up to the house saying you're afraid for your life.

This is the sort of shit that makes my blood boil. YOU ARE NOT ON THE DEFENSIVE so don't act like it. This is your house. You are not a villain.

Warnings: she will try to pre-emptively file restraining order. Get one first. Make shit up if you have to. You'll get the temporary RO. If she files one against you first, follow it to the letter. Get cops to assist any time you need to go to the house. Record EVERYTHING.

Something to keep in mind: nobody cares about your divorce or how much of an asshole your STBX is. The cops don't care, your lawyer doesn't care, the judge won't care. Just stay within the law and don't make yourself a target.

Move somewhere in the same school district if at all possible. Ask for majority parenting time in a temporary order. Ask daily in emails (nicely, like you're talking to the judge) to have your children overnight. Text her daily to talk to your kids.
Go to the store and buy a daily organizer. This is your new tool. Or do it on notepad on your phone/Google Docs, etc. Log each daily occurrence of emails and texts requesting parenting time and calls.

You see, she HAS to let you see and talk to your kids. One thing that kills mom most in trials is their unwillingness to foster a relationship with the father.

You need to remain closeby to have easy access to your kids. Even more than before, you need to shift all your life schedule around being there for your kids so when the judge looks to your availability you're in a good position for equal time. Equal time is your only goal right now. Fuck the house.
