Prolly each jurisdiction is different. I'm in Canada and asked my lawyer if I'm on the hook for child support and education costs... I obviously can't do both and I'm not borrowing money for that. He said your under no obligation to pay for your kids education if you can't afford it... My ex is of the opinion I have to pay. But my kids are a few years away from higher education. Awaiting a battle... I'd be willing to use the money I give for CS directly to the kids education. But the ex would fight that to the bitter end. Bottom line is the bank of dad only has so much money in it. Id expect my kids to get PT jobs and take out their own loans as I currently pay 50% CS. No extra money for anything over CS! I have to live too...

Dealing with this now myself. It depends on the school. You will be able to show your more current tax return to support the adverse economic circumstance. Many Private schools (and some state schools) however will ask for a more supplemental disclosure that will find the other parents income and may impute. (Each school is different). Good luck.

FAFSA looks at the tax return from 2 years prior. So you’ll be using data from 2020 assuming you’re applying for Fall 2023 term.
