I’ve posted here before about a housing issue but just need some legal advice on how to move forward.
Ex-wife and I were officially divorced early November of last year. We bought a $255k house together in June of the previous year that now is worth about $100k more.
In the settlement, I got a small ($5k) equity payment and she got the house since we lived there for like not even one year and barely had paid off even the interest on it. (I know I could have taken her for more but she didn’t touch my fat 401k, and I didn’t want to give her any ideas about sticking her hands in that honey pot.)
Now, the Divorce Decree stated that she had 90 days from Nov 13th to get the house re-financed in her name alone. If she was unable to do so or just straight up didn’t do it for whatever reason, the court would order the house sold, per the official court order.
Well, we are way past that obviously. She went on a cruise with my replacement, Mr. Wonderful, and forgot to pay the mortgage in February, even though I gave her instructions on how to do so until it was refinanced. This caused my credit score to plummet 80 points.
I’m deploying with the Army soon to a location where I won’t have access to internet most of the time, and I really need to be free of this house before hand, so what’s my best bet here? Do I need to get my attorney in the horn? All thoughts appreciated.
