One of you needs to file a petition for divorce in the state where the filer lives. Send a copy to the other and have them sign a waiver of formal service (most states allow this) and file it with the court. This is so the court will have subject matter jurisdiction over the marriage/divorce as well as personal jurisdiction over the non resident spouse.

Most courts have forms online that you can you to do simple divorce. Yours is simple because there are no children, and no assets or debts to be distributed.

If you wife wants her maiden name restored in the divorce she might want to be the petitioner.

You might want help with the paperwork but using a lawyer gets the price up. Sometimes you can find a freelance paralegal to help you with the proper forms for the filings.

Core documents are the petition, answer to petition and the final decree showing that both parties agree to the final decree in the actual form presented to the court.

If there is no answer then you need either proof of service of the petition or the waiver filed usually along with an affidavit regarding the soldiers and sailors act requirements.

I think Florida divorce laws are more strict than Ohio. I would file in Ohio.

If you guys have an agreement, it’ll probably take 30 minutes if time from the each of you.
