They will take 5 years tax returns and average it... Same applies if your in commission based or sales related income.

Depending on your state, there may or may not be a calculator. NEVER agree to lifetime alimony, only temporary alimony with a set end date and the verbiage “once terminated, alimony cannot be modified by any court”. Personally, if I had been given a lifetime sentence, I would have fled the US.

When calculating Alimony, for someone who has a varied income, the courts would average it out over the past 3 to 5 years of W2's and tax returns.

However, if an award of alimony is granted? This is basically what happens;

You start making half the money that you used to make. Court says "too bad so sad! Get another job! She needs to be supported 100%. And if you don't pay, can't pay, be prepared for contempt of court. No change in alimony."

You start making double the money that you used to make. Court says, "There's a change in financial circumstances, you need to start paying more."

If she starts making half what she used to make. Court says, "There's a change in financial circumstances, you need to start paying more."

If she starts making double what she used to make. Court says, "That's great for her. A real success story. no change to alimony."

The moral to the story? Fight the award of alimony tooth and nail!

alimony can usually be non-modifiable in most states I'm aware
