Section 1. Equality of rights under the law shall not be denied or abridged by the United States or by any State on account of sex. Any law passed by the United States or any State treating the sexes differently or which uniquely disadvantages or advantages one sex shall have to be in furtherance of a compelling governmental interest and be the least restrictive means of furthering that compelling governmental interest.
Section 2. Sex segregated facilities and sports maintained by the United States or any State shall be permitted if a compelling biological necessity for segregation can be demonstrated and members of the both sexes are provided with equal opportunities, amenities and services.
Section 3. Nothing in this article shall be construed as to deny the equality of rights and equal participation of transgenders. The Congress shall have the power to enforce this article by appropriate legislation.
What do you guys think about adding such an amendment to the Constitution? Do you think such an addition would be a good idea? I had to like know your thoughts. What changes would you make, if any?
