Prenupitals can be thrown out of court unless conditions are met.

You can't just give her a piece of paper to sign on her wedding day, she has to have lots of time, like 6 weeks or more, to review it.

She cannot "feel" pressured or manipulated in any way.

A prenup can't be exploitive. She cannot get nothing. She has to get something, generally a generous amount. State supreme courts have invalidated them by saying they were too "unfair".

Prenups cannot trump laws. So parts can be thrown out if they do.

She needs to have her own lawyer. You cannot share a lawyer, doing this can cause it to be thrown out. She must have an independent lawyer for her own interests.

She needs lots of time, cannot be pressured, must have legal representation, counter offers, etc.

Even then, if it's too unfair it can be thrown out.

All a prenup does is spell out that she's getting paid. You could do something like say your rare book collection is off the table, or maybe you plan to open a side business with a family member and maybe that's untouchable, maybe.

A prenup doesn't really prevent anything, as it in no way makes a marriage better, it just might possibly allow for a predetermined structured payout to be more palatable.

By all means get one, but that's just one of the many issues with marriage, that it requires even more contracts to try and protect things you rightfully own.

Having a prenup in no way prevents you from having an expensive court battle over the prenup itself.

there are some benefits for prenups, which is when you present it to your fiancé, you can quickly tell if she is a gold digger by her issue with it. A woman who "loves" you will have absolutely no problem signing one. A woman marrying for money always has a problem signing one.

When you read about them in articles, they'll always write the article as gender neutral, as if women actually marry down. Which means you know an article sides against the man, because women only marry up or sideways, whereas men don't really give a crap who they marry when it comes to that.

So best just to not do it, or hide your wealth in a way no one can discover.

Huffington post did an excellent multipart article on the problem with prenups, and by excellent, I mean it absolutely tries everything possible to screw the man and give everything to the woman. They play the non-gender language card, talk about love, try and screw over first time marriage people, and only say it's "bad" because it protects the richer spouses assets (always the man).

The whole goal of the HuffPo article was to convince everyone not to use prenups, and we all know why, although I'm pretty sure all the rich owners of HuffPo have prenups themselves.

In Australia - pre nups are useless. Courts simply do not enforce them - divorce lawyers walk all over them. The rights imbued in a legal system simply override any claim in a pre-nup.

Not sure if this is true in the US though.

Because most people would rather AVOID marriage - instead of getting a prenup. Don't marry. Simpler.

Prenups don't aways work. To work best, you also need a post nup. Why? A court can throw out a prenup for various reasons and call it null / void.

A contract sign under duress is not enforceable.

So if you say sign this or were not getting married you forced her to sign it and its not enforceable.

Wrong question.

The question is why are so many men dying to find ways to justify marriage and rationalize that it's okay using false senses of security like prenup?

Why are men so desperate to get married?

Getting a prenup before marrying is like wearing a bulletproof vest before shooting yourself in the chest.

Also, as an aside, prenups can be used to exploit men too. I remember one r/amitheasshole thread from a man who was getting married whose fiancée’s family wanted to “gift” them a house living close to them. They lived rural, in the middle of buttfuck nowhere. Not a problem for the woman, she worked from home. But the guy worked in the city and would have been forced to give up his career if he’d moved out there because the commute was three hours each way.

Then, they wanted him to sign a pre nup stating he relinquished all rights to the house, and only their precious daughter would get it in a divorce. Hang on. They were expecting him to give up his career, move to an area where he couldn’t get another job, AND sign documents leaving him with nothing in the event of divorce? Fuck off! He said he’d do them a deal: he’d sign the pre nup IF they gifted them a house in their current city, or he’d move but not sign the pre nup. Cue name calling by future in laws, screaming and calling him selfish.

Here in the west, pre-nups get thrown out all the time. The only thing that I've seen work well is a living trust that the groom set up even before the engagement, and transferred all his property to. She got some stuff like a vehicle that was purchased during the marriage, but not the house or any of the rental properties.

Pre nups or binding financial agreements are very tedious and easily thrown out of court if not done properly and kept updated...if youve had kids toether after it was written lodged you needa update it...any life xhanging experuence update...get me. The lawters ll luv you n if family courts deem it to be unfair they can over rule it.. and its about 5k for acheap one in oz...better off setting up a family trust...

If children are involved, pre-nups are literally null and void. "Best interests of the children" (paying mommy's rent) trumps any pre-nup written. Talk to divorce lawyers about pre-nups, or those men who thought they were protected. If you need a document to protect you from cohabiting with the "love of your life".... doesn't that make one stop a think a little bit?
