If the College authorities are actual policemen, they can arrest and detain you. However, if they are only teachers or administrators, they cannot detain you against your will. Now if you don't cooperate with them, the college has a right to kick you out or take other steps outlined in the student handbook. They do not however have a right to detain you involuntarily by force.

The actions many colleges are taking these days regarding allegations of sexual abuse and rape are highly disturbing from the perspective of civil rights and fundamental fairness. They are quite literally turning into McCarthy type witch hunts, with insanely biased panels and zero notions of achieving justice. I urge any college student facing charges of this type to immediately contact an attorney.

College kids are just that kids. Some are totally adults. Others are still like kids. For many of them, it is the first time living away from home. They tend to make lots of "mistakes", including getting drunk, having drunk sex, taking "no" as "maybe" and "maybe" as "yes". Colleges traditionally have tried to cover up these little trasgressions to give the kid another chance. A chance to make mistakes and to learn about living in society on your own.

They also engage in Cover Your Ass. Nobody wants to send their daughter to some school where she is going to be raped. So, schools try to minimize official rape reports by doing everything in house to prevent a crime statistic and a police record of the incident.

If an allegation of a criminally serious nature is made such as rape, how is the law enforcement not running the show?

Let's say you and I meet on the street. We say hello and begin a conversation. I don't like what you're talking about and slug you in the arm. You decide it's not worth your trouble to call the police but you want to let people know I'm a violent conversationalist, so you take my picture and put up flyers all around that neighborhood. It works something like that. Basically there needs to be a formal complaint made for the police to do something in most cases and colleges provide an informal way to complain. I'm not sayin' it makes sense but that's how it works.

I could be wrong here but I don't think they "detain" or question anyone who isn't a student. If a student makes a complaint about a non student I think the police are informed that a situation occurred but neither party takes action. Again I could be wrong and if anyone knows for sure one way or another please correct me.

Also if an allegation is made anonymously, does the alleged victim get legal advice and suggestions to seek a rape kit?

It depends who the anonymous complaint is made to and in what manner. If you're reporting online obviously not. If you're talking to the Title IX coordinator or someone from the schools Women's Center or whatnot they will probably suggest that you talk to the police and take a rape kit but ultimately it's up to the victim to choose whether or not to do those kinds of things.

If its anon how does the College reply to the alleged victim regarding their investigations?

Pretty sure they don't. They just follow up on the complaint. So Jessica anonymously accuses George of sexually assaulting her at a party. The school gets the complaint and now all their focus is on George because they don't know who Jessica is.

If you want to know more about this stuff most colleges and universities post their policies online. You can also read up on the Clery Act which I believe is what started most of the anonymous reporting thing.

Colleges or other self-managing educational institutions should never, ever investigate charges like this on their own. EVER.

This should be entirely handled by law enforcement. With the police you have a small chance at a fair hearing, in a college tribunal, you have NO chance of fairness.
