sigh universities shouldnt hear complaints of sexual assault at all. It is a criminal legal issue for courts and police. University administrators and conduct committees alike have none of the training required to hear such a case. It often takes skilled detectives years to build enough experience to handle such situations and now the federal government has handed such investigations over to amateurs. Sadly, it will take a few promient cases of fraud and false allegations to even begin to over turn this executive mandate. Because of course false allegations happen and in greater frequency than any other false claims.

Ultimately the logic in question is: are 10 innocent people being punished worth an easier discovery for 1 guilty person? The answer in light of thousands of years of jurisprudence precedent is NO.

That would be discrimination to say that officially publically, the wording usually goes something like, "why would she lie about such a thing and put herself through this?" Thus the female's word is taken at face value while the guy is assumed to be lying. This is the problem with adjusting the burden of proof so low, there is now a presumption of guilt. If sexual assault criminally legally is such a big issue why not reduce criminal procedings to a lower buden of proof as well? Its unconstitutional for one, but why can they do it at a university? Because its voluntary participation and colleges would lose title IX standing ($$$). So basically it reduces an individuals right or privledge to seek out an education, because of the lack of true freedom of speech and because of funding lost to the university.

Potential invisible victims are apparently more important than obvious victims of ruinous false allegations.

Nevermind the lack of physical evidence, and exclusionary exculpatory edvidence in most cases, many of the individuals with authority on such matters at universities often react with incomplete understanding of the subtleties of such a situation.
