I hope it's decided fairly.

[–]berderkalfheim 8 points9 points10 points 8 years ago (2 children) | Copy Link

If it's in California, I doubt it'll be fair, unfortunately.

Cali employment law is more strict than federal law in certain respects.

But not for political speech and opinions outside of non-profit orgs.

I find it slightly ironic this is being hosted on Google Drive...

[–]Lethn 4 points5 points6 points 8 years ago (0 children) | Copy Link

Let's be very careful on this one because we've seen how the media everywhere constantly misrepresents and lies about what this guy actually says and writes and it's because he's very credible. He's a Google insider and an engineer with a pretty intimate knowledge of how corporations like Google really work, they really don't want him blabbing or to have people listening to him.

I think I'd only trust anything that came direct from an account he owns or if there's a video of him talking about this stuff.

[–]IronJohnMRA 7 points8 points9 points 8 years ago (5 children) | Copy Link

I am reading the lawsuit filing now. He is not fucking around. If this goes through the court, and he wins big, it will be precedent setting. Things will change for businesses everywhere in the United States. Everyone is scared of a lawsuit. Now they will be scared of everyone suing, not just select groups. It will be a game changer.

[–]BlindGardener 0 points1 point2 points 8 years ago (4 children) | Copy Link

It'll just change businesses operating in California. He's using California to do this. Politics are not a protected class outside of California, and his emphasis is strongly on the Politics, not the White Male part, so it's unlikely that the ruling will be portable to other states where White and Male are technically protected, but not treated as such.

[–]IronJohnMRA 3 points4 points5 points 8 years ago (1 child) | Copy Link

While I'm not a legal expert I would speculate that this case will not end in California. I think it's likely to lose initially, and he will have to appeal, perhaps all the way to the SCOTUS.

[–]BlindGardener 1 point2 points3 points 8 years ago (0 children) | Copy Link

My understanding of law is that it can only make it's way up to the California supreme court, as it relies upon California state laws as opposed to federal laws. He could attempt a separate federal filing for the breaches of federal laws.

[+]Psychodeux1 points 8 years ago [recovered] (1 child) | Copy Link

Racial and gender discrimination are though. And he seems to have an even stronger case there

[–]BlindGardener 0 points1 point2 points 8 years ago (0 children) | Copy Link

He may have a stronger case there, but his filing seems to focus more heavily on the politics. Honestly, I wish he had chosen to focus on the racial and sexual discrimination.

I think maybe he thinks he has a stronger case for the politics.

The guy's memo that got him fired was batshit. Go read it

[–]YetAnotherCommenter 30 points31 points32 points 8 years ago (6 children) | Copy Link

Batshit?

It merely stated that one potential reason that women might be less interested (not "less able") in software engineering is that at the population level, the typical woman is more interested in working in a social context than the typical man. It acknowledged there is a very large amount of overlap between populations, that group-level averages say nothing determinative about any individual, and that it is imperative to treat every person as an individual rather than as a mere instance of a group. It then closed with a series of recommendations about how to make software engineering a more social activity so as to increase its appeal to the average woman.

That is not batshit. It takes a very broad but scientifically justifiable generality/postulated average tendency, explicitly accepted said tendency is merely a contributing factor and again only a broad generality that says nothing certain about particular individuals, and then suggested ways to increase a field's appeal to women on the basis of this generality.

Where's the batshit?

It didn't say "women can't code." It didn't say "women aren't fit for science." It didn't say "women should stay home, cook, clean and make babies." It explicitly advocated against stereotype-based reasoning and in favor of treating individuals as individuals.

He says unironically that conservatives are treated like gays of 1950s America (who still largely treat gays that same way now); talks about castrated men and turns the whole thing into a Left/Right Liberal/Conservative thing.

He's not men's rights, he's talking about politics overall

[–]YetAnotherCommenter 30 points31 points32 points 8 years ago (4 children) | Copy Link

He says unironically that conservatives are treated like gays of 1950s America

You mean that they are stigmatized, shamed and basically made to "keep it quiet"? Is that necessarily an incorrect assessment? It seems reasonable to me.

(who still largely treat gays that same way now)

Oh fuck you. Grow up. Tons of conservatives are either gay themselves or accepting of gay rights. The religious right is dying rapidly (thankfully). Then there are the libertarians, whom have been pro-gay since before the Democratic party was. And whilst yes, some conservatives don't like gay people or think homosexuality is immoral, the law in the US fully protects the rights of gay people including the right to marriage. The religious right lost the culture war. All the religious, anti-gay conservatives can do is disapprove.

Speaking as a queer man myself (albeit bisexual rather than gay), I don't care if some Backwater Baptist Blowhard fuckstains dislike my sexual proclivities. I hate their religion and disapprove of that. As long as they leave me alone, I have to tolerate their stupid faith as much as they have to tolerate my cultural nonconformity, militant atheism and sexual "sins" (by their standards).

If you have a look at today's "right" you'll notice the recent Republican National Convention's keynote speaker was an openly gay man who said he was proud to be gay on stage. Then Donald Trump said he aimed to protect LGBTQ Americans from Jihadism; the audience clapped. You'll note that right-wingers like Milo Yiannopoulos are utterly flamboyantly fabulous. You'll note that the anti-immigration parts of the "Alt-Lite" justify their policies in terms of protecting social liberalism, women's liberation and acceptance of gay and even trans people. This is Pim Fortuyn Liberalism, not some desire to go back to a world of God, Childbeating and Cornfields.

talks about castrated men

Citation please. I don't remember him saying anything like that in the memo.

and turns the whole thing into a Left/Right Liberal/Conservative thing.

Damore himself identifies as a centrist on his twitter profile, describes himself as an individualist and having classical liberal sympathies in the memo, and thus is not a conservative himself.

And sure, #NotAllLeftists, but these days the establishment left is increasingly embracing SJWism and is opposed to free speech. I remember the days when "liberal" used to mean culturally liberal, free-speech absolutists who defended Marilyn Manson against both the Christian Right and Hillary Clinton/Tipper Gore, but unfortunately those days are over. Culturally liberal people on the left have been cast out by the left-wing establishment and branded traitors. Look at how left-liberals like Dave Rubin and Sargon Of Akkad are constantly accused of being "alt-right" for fuck's sake. Look at how Glenn Greenwald (who seems to be a free speech absolutist) gets treated.

On campuses, in the media, the censors are all people on the left, operating from SJW ideology, and are aggressively targeting any ideas which are conservative, libertarian, or even "just not leftist enough."

You want to point the blame at people who made free speech into a partisan issue? You can't really blame the right for this. This new culture war was started by the left.

He's not men's rights,

Read the full complaint filed by his lawyers. Gender discrimination is one of the things he alleges. He alleges discrimination on three separate bases... gender (discrimination against men), race (discrimination against whites) and politics (discrimination against those perceived as conservative). Since he is the plaintiff in a suit alleging he and others were discriminated against because they were male (amongst other things), its a men's rights issue.

And since his opponents are part of a culture of rabid misandry, this also makes his case a men's rights issue.
