(Disclosure: IANAL. I am not a lawyer. In fact, I really don't claim that this is any better than a typical school paper, but if anyone is versed in criminal and/or constitutional law, please chime in!)

Summary: MRAs should act to protect the rights of the accused because they are fundamental human rights.

The Presumption of Innocence is necessary to individual human rights. It's as fundamental to human rights as due process and the rule of law since without it, a state can act to arbitrarily punish individuals even while adhering to due process and the rule of law. However, unlike other rights, it's not explicitly enshrined in the Constitution of the United States, though it is held to follow from the 5th, 6th, and 14th amendments. (Interestingly, it is explicit in the constitution of the Islamic Republic of Iran.) From the Presumption of Innocence, it follows that the Burden of Proof must reside with the accuser. Otherwise, it's easy to see how an individual could be untenably saddled with the burden of proof by multiple accusers.

This principle directly relates to problems for Men's Rights in the way Rape Accusation is handled. If the state can arbitrarily punish an individual by bringing accusations on behalf of an accuser, then this is tantamount to the state arbitrarily punishing individuals. Even many non-state organizations have enough resources to engineer the appearance of an accuser and many national governments have even greater resources. Even discounting the possibility of organizations acting in bad faith, there is still the possibility that individuals can make accusations in bad faith. Also, it follows from the standard of evidence of proof beyond a Reasonable Doubt, that the system should prioritize the protection of the innocent over the punishment of the accused.

For these reasons, the rights of Men who stand accused of rape are equivalent to the basic human rights of Due Process (5th Amendment of the US constitution) and the Presumption of Innocence. Therefore, it would be a great and beneficial aim of the Men's Rights movement to promote laws strengthening the fundamental right of the Presumption of Innocence. Not only is this right not explicitly enshrined in the US constitution, the original constitution was not written accounting for the implications of modern media and information networks. By working to strengthen laws in this fashion, the Men's Rights movement could act to protect individual human rights of both genders and further the cause of fair and rational treatment of gender issues by society.
