Basically at some point it will boil down to this. When a woman decides that Sex has been rape, also if it has been in the past, and if she had sex several time with that same partner, it will be rape. A woman will be able to turn the second time they had sex, out of, say, 12 times, into rape, because she says so.

Legalizing prostitution in Germany made the prostitutes life safer, as they (for example) have access to social services and legal protection for any harm might caused during work. Making it illegal again will bring us back to the time of forced prostitution.
