Courts are reminding some schools that in focusing on the rights of the victim, they cannot ignore basic tenets of fairness to the accused in their sexual assault process.

The victim?

And what are the "rights of the victim"? Aren't rights an issue only when you are accused?

Integrating these following five best practices will help schools ensure that their sexual assault policies and procedures satisfy OCR’s requirements and still protect the fundamental due process rights of all parties involved in the matter.

  1. Provide adequate notice to accused students.

  2. Allow the accused to challenge the complainant’s testimony.

  3. Allow the accused to present evidence in their defense.

  4. Separate the functions of investigator and adjudicator.

  5. Maintain a procedural record of the proceedings.

I don't think any US college will willingly do any of the above.

We don't even know who the "victim" is until after the trial... whether it was the accused or the accuser is one of the things the trial has to determine.

Of course, in both the accused and accuser roles--there are male accusers. But, the purpose of the trial is to determine what happened and who is to blame. Until the trial has concluded we can't determine who was the victim.

A not guilty verdict does not make the man a victim, and his life is probably already destroyed.

Sorry: I agree with what you say, but neither the law or anyone else will treat him as a victim, even after they charge the woman with making a false rape accusation, somehow the state is the victim. It's a horrible horrible thing and I think I phrased my responses badly.

By not believing every female false accusation of rape and letting criminal court s handle it.

But this will never happen so I hope they like losing money from lawsuits.
