Higher education has a major civil rights problem, and it’s so widespread that it’s nothing short of systemic and structural. The discrimination on the basis of sex and race that takes place on almost every college campus in America is not only illegal according to federal civil rights laws, but it’s highly unethical, unprincipled, and corrupt. It’s been going on for decades, but the violations of Title IX’s prohibition of sex discrimination and Title VI’s prohibition of discrimination on the basis of race, color, and national origin have increased in recent years, despite the ongoing efforts of myself and others to challenge the systemic sexism and racism that exists in higher education today. The two goals of this post are (1) to bring greater public awareness to the widespread hypocritical and selective double standard for the enforcement of federal civil rights laws on college campuses and (2) to suggest a “call to arms” for a coordinated national effort to expose and challenge the illegal violations of Title IX and Title VI that exist at most colleges and universities.

This gets talked about a lot here, hopefully he is successful.

Glad to see Mr. Perry talking about this in his blog. We have exchanged emails on this topic and I expected something like this would be published soon.

a. You can file an internal complaint by email with your university’s Title IX Office

I personally find filing with the school to be a tremendously bad idea. The school has already determined compliance or is willing to turn a blind eye. I have had schools handle complaints unofficially in "the spreadsheet" instead of filing in their system. They change the program then claim there is no violation. The school establishing a pattern of anti-male discrimination in their rulings puts them at risk. They won't do it. There is financial incentive to fuck you over. If you file with the school and they fuck around, it will make your complaint to OCR wayyyy more complicated and thus it will take longer for OCR to take action on it.

In example, a school ruled "no discrimination" for a for-credit women-only class that auto enrolled all freshman women engineers. I complained to OCR, who dismissed it saying the school already took action. Schools can and do issue fake rulings and OCR doesn't care.

b. If your university fails to respond or responds but is unwilling to properly correct its civil rights violation(s), you can then file an external Title VI or IX complaint with one of the Department of Education’s Offices for Civil Rights (OCR).

There is no obligation to file a complaint with the school before filing federally with OCR. You can even file with OCR while you have an active complaint with the school. Oftentimes OCR is slower, but OCR actually has enforcement capability. The school at best changes the program. OCR can place penalties and burdens on the school as punishment. OCR can force reporting on certain programs to ensure compliance. Schools won't do this on their own if you file with the school. Schools responding to your complaint with changes doesn't prompt other schools to make changes, but OCR forcing changes will.

Filing with OCR is easy. It doesn't require an attorney. It costs nothing. You don't need to be a legal expert. GET YOUR VOICE HEARD. If our complaints are filed with the school they don't contribute to the national narrative like they do if we file with OCR.

CALL TO ACTION

There are a couple of us out here working on changing things, but we need your help badly. If you go to a college in the US, help by reaching out to me with info on programs. If you are in the US (student or not) consider filing complaints with OCR. This is snowballing fast, we can change these things if more people help with a couple hours on a weekend. We have to keep momentum, and with the new title IX changes coming the timing to get involved is perfect.
