Really when you think about what he said it is bullshit. A guy can walk around with no shirt on without it being a big deal, but if a woman does it she's leading someone on or inviting rape?

and its not a bad idea not to go wondering around drunk off your arse at 3am wearing little more then underwear

Firstly, "the victim is drunk or high" isn't rape in the UK. Not unless they were actually drugged against their will.

Buuuuut given that it also isn't rape in the UK if it's by a woman, I'm going to assume he didn't know that either and is just going from what the common definition is.

Other fun fact: as far as I can tell (and I looked profusely), Ireland gets around this issue by not legally defining consent! They use the word in laws, but they don't give it an actual meaning. As crazy as it sounds to have a law that can be interpreted as anything*, I actually like it because, no, consent is not something so easily definable. Like a... easy guy gets drunk with a hot girl he's obviously interested in, and then they have sex, that's hardly rape. But if the hot girl pulls a bait-and-switch tactic (gets a guy interested in her drunk, then brings in an ugly friend, with the specific intent of the two hooking up), that is.
