Hi guys, so I've been thinking about a legal solution to the issue of false accusations. The biggest problem with false accusations is that the current legal standard for conviction is a confession; simply proving that you couldn't possibly have committed the rape is not grounds for prosecution of the accuser. So here's how I think the system should change:
- If a crime is alleged, but nobody specific is accused, the alleger should have immunity from prosecution from a false accusation.
- If a crime is alleged, and someone specific is accused, the alleger should be prosecuted if the accused can prove that they couldn't possibly have committed the crime. Also, an allegation against a specific individual should not be investigated unless the alleger names a specific time, date, and location (such that the allegation can be disproved).
