I do and don't have a problem with title 9. This may not be a popular opinion but for the most part I'm... okay with it...

I see the argument made that it shouldn't be handled by the school, but by the police. I'm not so convinced about that. Things can be against school policy that might not be illegal. A jilted lover who stands on the sidewalk and follows a girl around probably doesn't rise to the level of illegal. However it's creepy as shit and no one should have to put up with that. A school could take action against the student if the police couldn't.

I've also seen the arguments made that it requires "a preponderance of evidence". That's true, but again I'm not convinced this is necessarily a bad thing. A school does not have the time, money, or expertise to get to that level. If that level is even achievable Additionally the stakes are much lower. The worst that can happen is you get expelled (Ignoring the social consequences for a minute). With lower stakes a lower threshold of evidence is required.

I don't even blame the schools. I blame the shitty directive. Think about it, a school would cease to exist if it lost federal funding, therefore those schools are going to make absolutely sure they are over protective. This is a normal response to such a shitty rule with poorly defined procedures, with such ghastly consequences.

Title 9 becomes a problem because we have 50,000 schools each interpreting a shitty directive in there own way, and all of them are doing this under the Sword of Damocles. Title 9 could be kept as is, the procedures need to be laid out, so that everyone knows what is expected, and what the steps in the process are.

My personal opinion but here's the way I feel it should work. If an accusation is made, the two parties should be separated from any joint classes, and tutors are brought in to catch them up on any work missed. If they have two classes together, the victim will receive the tutor for one and the accused will receive the same for the other.

The alleged victim should receive counseling, and should be encouraged to talk to the police if a criminal action is suspected

Both parties should be advised that they are not to talk about it with anyone (councillors excluded). If they break this rule that should lead to expulsion. This prevents the shit show that was the mattress girl. She should have been expelled.

At a minimum the tribunal should be run by a lawyer. Preferably the schools lawyer, and both sides should be allowed legal representation. The trouble comes with cross examination. I think a fair compromise is that cross examination is not required. If allowed or if the accused wishes to cross exam then the accused can not hide hide behind the fifth and must allow the victims attorney to cross examin them. I'm not 100% on this, but if we have a he/she said, then it's not fair for one to be subject to it and not the other.

Legal tribunals outside the judiciary are a prescription for massive errors either way.

Title 9 was intended to refer to access not rape. Feminist courts and governance have made it an Orwellian instrument.

The D.C. letter illegally circumvented the APA.

It is a fundamental violation of human rights for an amateur, kangaroo court to try a male for a crime with severe penalties which destroy his life.
