How would you reform the Divorce System?

I'm not in favor of removing "no fault". Think how long it would take to prove a woman is a conniving bitch and sits on her ass. It's not as easy as you think.

If kids are involved, 50/50 joint custody is mandatory except under extenuating circumstances. I am not willing to make the pendulum swing the other way, kids need both parents as a balance.

He's a rapist? He's an abuser? Prove it!

She lied about stuff to get an advantage? Her ass goes to jail.

Permanent alimony has almost disappeared. I think Florida might be the last one to have it.

The #1 thing that would change divorce would be to change marriage in the first place. Besides not doing it. Make marriage a legal contract where all the terms and penalties are spelled out IN ADVANCE instead of the whims of a judge. "But he told me a few years ago when we were drunk that he doesn't mind if I kissed another guy, so that's permanent!" "Sorry, it's not in the contract, it doesn't fly."

Require AFFIRMATIVE CONSENT for procreation. No "oops" babies, which we all know were planned by mom.

Allow the terms of the marriage to be revisited every five years or so to allow for changes in the marriage. Changes must be accepted by BOTH PARTIES. Things can and do change and the marriage contract must be changed to reflect that.

Allow marriage contracts to expire, and detail terms IN ADVANCE for when they expire.

Marriage should be a way for a couple to build a life together, not for women solely to get cash and prizes.

No alimony, no child support, no welfare state. Keep no fault divorce, if a woman can't score free gravy she'll stick with the man she married.

To reform divorce:

Repeal the 19th amendment.
Women are not citizens.
Women are property of their fathers at birth and until such time as: her father dies OR she is married OR she is sold OR she dies.
When a woman marries she becomes property of her husband.
Her husband may kill her at will.* Divorce can happen only when her husband declares himself divorced from her. She may leave with the clothes on her back with zero other assets.

It's impossible to get the government out of marriage; huge swath's of our populace are irresponsible and fuck their lives up and their children's lives up. However, governments role should be minimum and it should force people to have a savings account for their offspring so that society is not as burdened. Here's what my ideal world would look like

-no official state marriages

-religious or secular organization marriages recognized and documented publicly by state but no benefits related to the recognition.

-When a married female gets pregnant both parties are required to equally contribute to a child of divorce savings account. (the man is entitled to state funded testing if he requests it.) (These saving accounts would be privately owned so that people could shop around for a fund with a good return but also backed up for their minimum amount like an FDIC system).

-unmarried females and females refusing to marry after conception receive zero claims on male finances and zero state support (outside of maybe basic WIC and prenatal/ early childhood medical care).

-divorce = savings account pays out equally to both parties regardless of number of children. Joint property is split with help from the court system. Pre-marriage property goes to original ownership.

-no fault divorce = savings account split and visitation split. 50/50

-fault divorce = savings account and visitation decided by a judge. Regardless of decision man or women no longer is required to pay into savings account. Reduction of male visitation rights must be based on evidence like criminal conviction.

-Couples that stay together until a child finishes the compulsory school age (16) may use saving funds for education expenses or retirement at their choosing.

-When all children are no longer claimed as dependents the parents may have full access to the savings accounts and are also no longer required to pay into the accounts.

This system eliminates alimony, reduces the need for welfare, and reduces a bloated family court system. It puts more money into the economy. It incentivizes women to stay married but still gives them options. Finally, it removes a manipulation tool the government has to punish single people and reward people that have children (i.e child tax credit).

Bringing back at fault divorce is one option.
Presumptive shared custody would be a good idea.
Certain aspects of child support should be reformed.
Adoption of alimony guidelines so everyone knows what they are in for (an attempt has been made in Canada; they are guidelines, not law but judges take them into consideration).
Get rid of common law marriages and anything like them.
In general, put the onus back on women to secure a man's commitment before being able to rape him financially when the woman leaves.

I wouldn't because it is on a state-by-state basis so you would be changing 51 different legal systems which would take forever and cost to much. A better option is simply don't marry, just cohabit if you want or have a baby by surrogate. I would not have children either unless you make over six figures. As they get older children get more expensive.
