Are you in state where you have to show cause? I am finishing up my divorce in Texas and it was all about finances - text messages never came up.

Probably none unless she needs something specific. In that case, why in the world would you keep it on your phone? As far as the service provider records are concerned, that's something to take up with them.

Once the divorce begins, her lawyers can ask for anything through Discovery. But Discovery has limits. You can even Google 'objections to discovery' to see a list. Relevance is a big one. You can easily object to Discovery that will likely not lead to anything relevant.

So, here's the question...

If, for example, she'll countersue you for cheating on her, and if there are text messages out there that confirm her side of the story, they will likely get admitted. I have no idea how long the phone company keeps a copy; ask them.

But "at-fault" divorces (e.g.: bringing abuse and infidelity into court) are rare because they are expensive and difficult to prove. More than likely, you'll have a "no-fault" divorce which is just what it sounds like: No one is at fault.

In that case, if you've cheated, the text messages mean nothing. They are irrelevant.

Unless there is a custody fight, text messages aren't usually brought into a court. Why do you think the opposing lawyer will ask to see yours? Message to and from whom?

EDIT: Dude, there are a million secure, destructive messaging apps out there for free. Damn, and you're skating on thin ice with SMS?
