I got divorced two yrs ago. We have three kids. Their mom has lost so many jobs the kids have ended up living w/ me for over a year. And their mom is renting a room in my house. Our finalized agreement was to take turns claiming the kids 2 one year, 1 the next, etc. When I did my 2016 taxes I answered the questions turbo tax gave me and it said I qualified for Earned Income Credit. However that caused my ex to not be able to claim any of the kids. So I amended my return and forfeited the EIC so she could claim one. My question is do I have to go to court and get the divorce decree changed in order to claim EIC next year? I'm paying all the bills, utilities, etc. Any thoughts?
